Download or read book Choice of Law in Copyright and Related Rights written by Mireille M. M. van Eechoud and published by Kluwer Law International B.V.. This book was released on 2003-01-01 with total page 306 pages. Available in PDF, EPUB and Kindle. Book excerpt: Nobody denies that the traditional territorial approach to copyright and other intellectual property rights has come under pressure. Yet it persists. Faced with the need to determine the applicable law in cross-border cases, lawyers everywhere wrestle with the implications of the territorial nature of copyright and related rights. In this book Mireille van Eechoud clears the way to the formulation of conflict rules that reflect the purpose of copyright law- to protect creators and stimulate the production and use of information- without reverting to old-fashioned notions of territoriality. She shows how the applicable law can be determined for four distinct legal avenues of intellectual property law: Which exclusive rights exist in an intellectual creation and for how long; Who is considered to own such right; How can these rights be transferred; and What continues infringement of copyright and related rights. Mireille van Eechoud shows how, when each of these questions is approached in the light of the different allocation principles used in modern choice of law, a new clarity begins to emerge that promises in time to build a set of conflict rules well suited to the unprecedented copyright and related rights issues that we find so difficult to resolve today. Her in-depth analysis draws in the classis multilateral conventions and treaties, underlying policies, technological and economic developments, utilitarian grounds versus justice considerations, and issues of infringement in the digital environment. Download or read book Why We Play written by Roberte Hamayon and published by Hau. This book was released on 2016 with total page 343 pages. Available in PDF, EPUB and Kindle. Book excerpt: Play is one of humanity's straightforward yet deceitful ideas: though the notion is unanimously agreed upon to be universal, used for man and animal alike, nothing defines what all its manifestations share, from childish playtime to on stage drama, from sporting events to market speculation. Within the author's anthropological field of work (Mongolia and Siberia), playing holds a core position: national holidays are called "Games," echoing in that way the circus games in Ancient Rome and today's Olympics. These games convey ethical values and local identity. Roberte Hamayon bases her analysis of the playing spectrum on their scrutiny. Starting from fighting and dancing, encompassing learning, interaction, emotion and strategy, this study heads towards luck and belief as well as the ambiguity of the relation to fiction and reality. It closes by indicating two features of play: its margin and its metaphorical structure. Ultimately revealing its consistency and coherence, the author displays play as a modality of action of its own. "Playing is no 'doing' in the ordinary sense" once wrote Johan Huizinga. Isn't playing doing something else, elswhere and otherwise ?
Download or read book The Effects of Financial Crises on the Binding Force of Contracts Renegotiation Rescission or Revision written by Başak Başoğlu and published by Springer. This book was released on 2016-02-25 with total page 340 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is about one of the most controversial dilemmas of contract law: whether or not the unexpected change of circumstances due to the effects of financial crises may under certain conditions be taken into account. Growing interconnectedness of global economies facilitates the spread of the effects of the financial crises. Financial crises cause severe difficulties for persons to fulfill their contractual obligations. During the financial crises, performance of contractual obligations may become excessively onerous or may cause an excessive loss for one of the contracting parties and consequently destroy the contractual equilibrium and legitimate the governmental interventions. Uncomfortable economic climate leads to one of the most controversial dilemmas of the contract law: whether the binding force of the contract is absolute or not. In other words, unstable economic circumstances impose the need to devote special attention to review and perhaps to narrow the binding nature of a contract. Principle of good faith and fair dealing motivate a variety of theoretical bases in order to overcome the legal consequences of financial crises. In this book, all these theoretical bases are analyzed with special focus on the available remedies, namely renegotiation, rescission or revision and the circumstances which enables the revocation of these remedies. The book collects the 19 national reports and the general report originally presented in the session regarding the Effects of Financial Crises on the Binding Force of Contracts: Renegotiation, Rescission or Revision during the XIXth congress of the International Academy of Comparative Law, held in Vienna, July 2014.

Download or read book The Effectiveness of Environmental Law written by Sandrine Maljean-Dubois (juriste)) and published by . This book was released on 2017 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is the third volume in the European Environmental Law Forum (EELF) book series. The EELF is a non-profit initiative of environmental law scholars and practitioners from across Europe aiming to support intellectual exchange on the development and implementation of international, European and national environmental law in Europe. One of the activities of the EELF is an annual conference. This book is comprised of fifteen contributions presented at the Third EELF Conference in Aix-en-Provence, hosted by the Central European Research Infrastructure Consortium, at Aix-Marseille University, September 2015. The central topic of the book is the effectiveness of environmental law. The impressive development in environmental law has not always been matched by corresponding improvements in environmental quality. The threats to our environment and, by extension, to our health have never been so numerous or serious. But paradoxically, the effectiveness of environmental law has been a long-neglected issue. This book offers a fruitful and stimulating dialogue between practitioners and academics, from varied countries and varied fields, combining empirical and theoretical approaches. The contributions go from classical-but still necessary-tools (control, criminal, administrative, civil sanctions, liability rules, strengthening of the regulatory structure, and the role of judges), to more innovative ones (public participation, effectiveness of instrument mixes, collaborative governance, hybrid governance, and private environmental enforcement). Download or read book The Family in Question written by R. D. Grillo and published by Amsterdam University Press. This book was released on 2008 with total page 321 pages. Available in PDF, EPUB and Kindle. Book excerpt: The family lives of immigrants and ethnic minority populations have become central to arguments about the right and wrong ways of living in multicultural societies. While the characteristic cultural practices of such families have long been scrutinized by the media and policy makers, these groups themselves are beginning to reflect on how to manage their family relationships. Exploring case studies from Austria, the Netherlands, Norway, Portugal, Spain, Switzerland, the United Kingdom, and Australia, The Family in Question explores how those in public policy often dangerously reflect the popular imagination, rather than recognizing the complex changes taking place within the global immigrant community.

Download or read book The Life of August Wilhelm Schlegel Cosmopolitan of Art and Poetry written by Roger Paulin and published by Open Book Publishers. This book was released on 2016-02-01 with total page 680 pages. Available in PDF, EPUB and Kindle. Book excerpt: This is the first full-scale biography, in any language, of a towering figure in German and European Romanticism: August Wilhelm Schlegel whose life, 1767 to 1845, coincided with its inexorable rise. As poet, translator, critic and oriental scholar, Schlegel's extraordinarily diverse interests and writings left a vast intellectual legacy, making him a foundational figure in several branches of knowledge. He was one of the last thinkers in Europe able to practise as well as to theorise, and to attempt to comprehend the nature of culture without being forced to be a narrow specialist. With his brother Friedrich, for example, Schlegel edited the avant-garde Romantic periodical Athenaeum; and he produced with his wife Caroline a translation of Shakespeare, the first metrical version into any foreign language. Schlegel's Lectures on Dramatic Art and Literature were a defining force for Coleridge and for the French Romantics. But his interests extended to French, Italian, Spanish and Portuguese literature, as well to the Greek and Latin classics, and to Sanskrit. August Wilhelm Schlegel is the first attempt to engage with this totality, to combine an account of Schlegel’s life and times with a critical evaluation of his work and its influence. Through the study of one man's rich life, incorporating the most recent scholarship, theoretical approaches, and archival resources, while remaining easily accessible to all readers, Paulin has recovered the intellectual climate of Romanticism in Germany and traced its development into a still-potent international movement. The extraordinarily wide scope and variety of Schlegel's activities have hitherto acted as a barrier to literary scholars, even in Germany. In Roger Paulin, whose career has given him the knowledge and the experience to grapple with such an ambitious project, Schlegel has at last found a worthy exponent.
