All'epoca, come oggi, in libreria si trovavano solo (o quasi) manuali di teoria pura oppure di pareri già svolti, ma nessuno che mi spiegasse effettivamente come bisognasse fare per redigere un parere in modo corretto. Il presente manuale è stato studiato per poter facilitare lo studio del candidato, per quanto riguarda il parere di penale, nell'affrontare l'esame di abilitazione alla professione forense alla luce della nuova formula che non prevede l'uso dei codici commentati.Il manuale è composto da 3 sezioni. Nella prima sezione ho riportato e trattato i maggiori istituti di diritto penale, senza avere la pretesa di poter essere esauriente come i migliori manuali, ma certamente ho concentrato l'attenzione sui concetti non solo più importanti, ma quelli che potranno rivelarsi più utili per la redazione del parere in sede di esame.Nella seconda sezione ho illustrato la metodologia per analizzare i singoli reati. Ho analizzato alcune fattispecie di reato di ogni titolo del codice penale nonché due fattispecie previste da leggi speciali. Una riguardante il testo unico sulla droga e l'altra la responsabilità amministrativa degli enti e delle società. Il codice penale e le norme incriminatrici ci dicono già tutto, basta solo saper leggere ed interpretare.Nella terza sezione invece ho illustrato la tecnica per poter redigere materialmente il parere. Ho svolto in modo esemplificativo alcuni pareri, nei quali ho illustrato e spiegato passo dopo passo, come sono arrivato alle varie considerazioni. A questi si aggiungono alcuni pareri svolti, che possono essere utilizzati come esercizi pratici.

Per ogni singolo atto o parere sono riportati la giurisprudenza di riferimento (utile per l’analisi e la soluzione del caso proposto), la normativa, le informazioni necessarie per la redazione dell’elaborato e, soprattutto, delle “brevi indicazioni per lo svolgimento”, congegnate ad hoc, che consentono di impostare il quesito e svilupparne la soluzione, sciogliendo adeguatamene tutti i nodi espressi dalla traccia assegnata. Alcune tracce proposte sono affrontate sia sotto forma di parere che di atto, proprio per dar risalto alle diverse tecniche di stesura ed argomentazione che accompagnano le due differenti prove. Da segnalare le seguenti tracce: - concorso di persone nei reati (parere n. 2) - abuso d'ufficio (parere n. 8) - adescamento di minorenni (parare n. 12) - responsabilità penale dell'amministratore di condominio (parere n. 24) - responsabilità medico (atto n. 22)
