Since the end of World War II, fraternity has been cited in several national constitutional charters, in addition to the United Nations Universal Declaration of Human Rights. But is there space for fraternity in law? The contributions to this book form an ideal “bridge” between the past and present to trace the different pathways taken to address the meaning of fraternity, and to identify its possible legal relevance. The book lays out paths that have placed fraternity in varied and challenging legal contexts in an age of globalization and conflict, where the multiplicity of national and supranational sources of law seems to show its inadequacy to govern complexity, and coexistence between diversities that appear irreconcilable. The purpose is not to recover fraternity as a forgotten principle, but to reimagine it today to address the aim and force of law within a plurality of cultures. The analysis considers a possible universal dimension that models unity within diversity, and aspires to serve as a prologue to a transition from research to dialogue between different legal systems and traditions. The book will be of interest to academics and researchers working in the areas of Comparative Law, Legal History and Legal Philosophy.

Ecco perché la Riforma Cartabia ha valorizzato, tra le altre, la Mediazione Familiare per quelle che sono le sue specifiche finalità. In vista della prossima fase di emanazione dei decreti attuativi, l’Associazione GeA Genitori Ancóra, ha presentato al Legislatore le proprie osservazioni e gli elementi di criticità ravvisati nella Riforma, ha organizzato incontri di confronto e dialogo nella consapevolezza dell’importanza che la lettura della Riforma avvenisse attraverso tutti i protagonisti che ruotano attorno alla famiglia in crisi e in conflitto: Giudici, Avvocati, Mediatori Familiari.

Various of today’s thinkers have predicted the decline or even the end of national ideologies. In the area of language, postmodernism would make the linguistic affiliation of the community individuals irrelevant, de-ideologise language use, and extend plurilingualism and language alternation in association with a new distribution of (physical or functional) spaces of linguistic practice. But is this true everywhere? Are languages now nowhere the core of collective identity? Or are we witnessing a distinction between languages that, because of their magnitude, status, strategic position, etc., can continue to exercise the function of national languages and languages that have to renounce this function? Has national linguistic ideology really ceased to make sense? What other strategies should the historic language of a given geographic area employ if it wants to continue forming part of the life of the community that is set up there? What kinds of languages are desired by politicians, intellectuals and philologists? This book aims to bring some thoughts about these questions.
