The intention is to point out the major differences between the legal realities, which significantly affect the process of translation. Secondly, the following characteristic features of lingua legis, concerning the level of words and syntagmas, are touched upon: vocabulary used in lingua legis including technical and semi-technical terms, conservatism of legal texts (Latin and Latinisms; synonymous strings, archaic adverbs etc.), borrowings, terms with non-precise meanings (the problem of indeterminacy), neologisms, euphemisms, vulgarisms, performative verbs, metaphors and religious elements, prepositional phrases, time expressions, compound nouns and the problems connected with nominalization, false cognates which cause major misunderstandings, and finally methods of providing translation equivalents. The problem of ambivalence is analysed as well. The problems connected with the Polish-English and English-Polish translation of the texts belonging to the following legal genres are examined: university diplomas and certificates, statutes, judgments, law reports, powers of attorney, petitions, contracts and deeds, testaments, birth, death and marriage certificates, and popular fiction.

Unfortunately, over-reliance on such outsourcing has given rise to significant dangers, including information asymmetry, goal divergence, and risk. Legal Translation Outsourced provides the only current reference on commercial legal translation performed outside institutions. Juliette Scott casts a critical eye on the practice as it now stands, offering an analysis of key risks and constraints. Her work is informed by empirical data of the legal translation outsourcing markets of 41 countries. Scott proposes original theoretical models aimed both at training legal translators and informing all stakeholders, including principals and agents. These include models of legal translation performance; a classification of constraints on legal translation applying upstream, during and downstream of translation work; and a description of the complex chain of supply. Working to improve the enterprise itself, Scott shows how implementing a comprehensive legal translation brief--a sorely needed template--can significantly benefit clients by increasing the fitness of translated texts. Further, she opens a number of avenues for future research with an eye to translator empowerment and professionalization.

The legislative varieties of eleven EU official and working languages (Dutch, English, Finnish, French, German, Greek, Italian, Latvian, Maltese, Polish, Spanish) are analyzed using corpus methodologies in order to investigate the variational dynamics and translation-induced patterns of the different languages. The underlying assumption is that, within the sociolinguistic continua of the EU languages, it is possible to single out specific legislative varieties (Eurolects) that originate at a supra-national level. This research hypothesis is strongly supported by the empirical findings derived from detailed corpus analyses of each language. This work represents the first systematic and comprehensive linguistic research conducted on a wide range of EU languages using the same protocol and applying corpus methodologies to the extensive Eurolect Observatory Multilingual Corpus.

The impact of sometimes contrasting factors such as the conventions of legal drafting at the European Union and those within the target culture, the principle of equal authenticity and the attention to the quality and readability of legislative texts is revealed in the analysis. Evidence in support of the theories concerning translation universals is also found and their implications for EU legal translation are discussed. The results lead to the formulation of several hypotheses as regards the norms governing the translation of EU legislative texts. The book also reflects on the impact that the translational choices have on the development of European Union legal language as an independent variety. Book excerpt: Translating Institutions outlines a framework for research on translation in institutional settings, using the Finnish translation unit at the European Commission as a case study. Because of their foundational multilingualism, the institutions of the European Union could be described as both translating and translated institutions. The European Commission alone employs nearly two thousand translators, and it is translators who draft the vast majority of outgoing EU messages. Translating Institutions sets out to explore the organizational role and professional identity of this group of cultural mediators, a group that has remained relatively invisible despite its size and central institutional role, and to use the analysis of this data to elaborate broader methodological and theoretical issues. Translating Institutions adopts an ethnographic approach to explore the life and work of the translators at the centre of this study. In practice, this entails employing a number of different methods and interrogating various types of data. The three-level research design used covers the study of the institutional framework, the study of translators working in specific institutional settings, and the study of translated documents and their source texts. This is therefore a study of both texts and people in their institutional habitat. Given the methodological focus of the volume, the different methods and data are outlined in independent chapters: the institutional framework of translation (institutional ethnography), the physical location of the unit (observation), translators' own views of their role (focus group discussions), and a sociologically-oriented text analysis of a sample document (shifts analysis). Translating Institutions constitutes a valuable contribution to the sociology of translation. It opens up new avenues for research and offers a detailed framework for the study of institutional translation.

Specifically, how can it attain both legal integration and language diversity simultaneously, without the latter compromising the former? C.J.W. Baaij argues that the answer lies in the domain of translation. A uniform interpretation and application of EU law begins with the ways in which translators and jurist-linguists of the EU legislative bodies translate the original legislative draft texts into the various language versions. In the European Union, law and language are inherently connected. The EU pursues legal integration, i.e. the incremental harmonization and unification of its Member States' laws, for the purpose of reducing national regulatory differences between Member States. However, in its commitment to the diversity of European languages, its legislative institutions enact legislative instruments in 24 languages. Language Diversity and Legal Integration assesses these seemingly incompatible policy objectives and contemporary translation practices in the EU legislative procedure, and proposes an alternative, source-oriented approach that better serves EU policy objectives. Contrary to the orthodox view in academic literature and to the current policies of the EU, this book suggests that the English language version should serve as the original and only authentic legislative text. Translation into the other language versions should furthermore avoid prioritizing clarity and fluency over syntactic correspondence and employ neologisms for distinctly EU legal concepts. Ultimately, Baaij provides practical solutions to the conflict between the equality of all language versions, and the need for uniform interpretation and application of EU law.
