Book excerpt: Il Decreto Semplificazioni (DLgs 76/2020) ha previsto l’introduzione di un organismo d’importanza strategica per centrare l’obiettivo di garantire una esecuzione delle OOPP celere e a regola d’arte: il Collegio Consultivo Tecnico. Dal momento che la gran parte delle controversie che ritardano o compromettono la qualità della realizzazione delle OOPP sono di ordine tecnico (sospensioni, varianti, ordini di servizio etc.) o giuridico (pretese e obblighi corrispettivi) che sorgono successivamente all’affidamento dei lavori, il Decreto Semplificazioni attribuisce a questo organismo un compito non solo, e non tanto, di consulenza ma di decisione e risoluzione in corso d'opera di qualsiasi controversia o disputa che sorga con l’appaltatore, evitando così che l’attesa delle decisioni ritardi o lasci in sospeso la conclusione dell’appalto. Il Decreto ha stabilito che la costituzione del CCT sia obbligatoria ma non ha disciplinato in dettaglio il suo funzionamento né i suoi rapporti con gli istituti già esistenti per la risoluzione delle controversie. Per riempire questo vuoto normativo, senza attendere l’emanazione di atti legislativi in forma di regolamento o di decreto attuativo, sono state emanate dal Consiglio Superiore dei Lavori Pubblici delle Linee guida per orientare l’interpretazione del nuovo istituto e assicurarne l’omogenea applicazione da parte delle stazioni appaltanti. La pubblicazione riproduce le relazioni tenute al Convegno organizzato il 4 febbraio 2021 dal Consiglio Superiore dei Lavori Pubblici, unitamente a CNI ed ANCE, ed è corredato da un'appendice normativa recante il testo delle Linee Guida e le principali norme di riferimento.
