Italian populism is of interest to comparative lawyers for many reasons. Firstly, the country has a long-lasting tradition of anti-parliamentarism over the course of its history as a unitary state. After the 2018 general election, it has turned into the first European country in which two self-styled populist parties formed a coalition government. Although it collapsed in August 2019, many issues that it had raised remain. Secondly, as Italy is a founding member of the European Communities, the constitutional implications of populist politics have to be considered not only within the national framework but also in a wider context. This book argues that the relationship between populism and constitutionalism should not be seen in terms of mutual exclusion and perfect opposition. Indeed, populism frequently relies on concepts and categories belonging to the language of constitutionalism (majority, democracy, people), offering a kind of constitutional counter-narrative.

During his confinement for his anti-fascist beliefs, the Italian political philosopher Carlo Rosselli (1899-1937) wrote this work not only as a critique of fascism, but also as an investigation into the history of Marxism and the need for a liberal reformulation of socialism. In this first English- language edition, Nadia Urbinati highlights both the historical and theoretical importance of Liberal Socialism, which continued to inspire the anti-fascist movement "Giustizia e Liberta." long after Rosselli's assassination by Mussolini's agents, and which outlines a possible rebirth of the socialist and democratic movements. Rosselli's analysis provides an illuminating interpretation of the ideological crisis of Marxism, in its positivistic version, during the late nineteenth century and exposes the intellectual weakness of revisionist efforts to delineate new versions of Marx's doctrine. He encourages readers to view socialism as an ethical ideal and to consider whether Marxist or liberal methods combine better with socialism to achieve that ideal. Rosselli opts for a liberal socialism that avoids the shortcomings of uncontrolled laissez-faire but favors state intervention to secure public services and social rights. Book excerpt: From the tone of the report by the President's Commission for the Study of Ethical Problems in Medicine and Biomedical and Behavioral Re search, one might conclude that the whole-brain-oriented definition of death is now firmly established as an enduring element of public policy. In that report, Defining Death: Medical, Legal and Ethical Issues in the Determination of Death, the President's Commission forwarded a uni form determination of death act, which laid heavy accent on the signifi cance of the brain stem in determining whether an individual is alive or dead: An individual who has sustained either (1) irreversible cessation of circulatory and respiratory functions, or (2) irreversible cessation of all functions of the entire brain, including the brain stem, is dead. A determination of death must be made in accordance with accepted medical standards ([1], p. 2). The plausibility of these criteria is undermined as soon as one confronts the question of the level of treatment that ought to be provided to human bodies that have permanently lost consciousness but whose brain stems are still functioning.
