Download or read book Encyclopedic Dictionary of Roman Law written by Adolf Berger and published by American Philosophical Society. This book was released on 2024-04 with total page 498 pages. Available in PDF, EPUB and Kindle. Book excerpt: This Dictionary: explains technical Roman legal terms, translates & elucidate those Latin words which have a specific connotation when used in a juristic context or in connection with a legal institution or question, & provides a brief picture of Roman legal institutions & sources as a sort of an introduction to them. The objectives of the work, not the juristic character of available Latin writings, therefore, determined the inclusion or exclusion of any single word or phrase. This dict. is not intended to be a complete Latin-English dict. for all words which occur in the writings of the Roman jurists or in the various codifications of Roman law. The reader must consult a general Latin-English lexicon for ordinary words that have no specific meaning in law or juristic language. Reprinted 1980.
Download or read book Gaius meets Cicero written by Tessa G. Leesen and published by BRILL. This book was released on 2010-09-24 with total page 372 pages. Available in PDF, EPUB and Kindle. Book excerpt: Gaius Meets Cicero. Law and Rhetoric in the School Controversies sheds new light on a much debated issue in the field of Roman law, i.e. the so-called 'school controversies' between the Sabinians and the Proculians. Tessa Leesen rejects the general assumption in modern literature that the two schools each adhered to a fundamentally different theoretical conception of law. She argues that the 'school controversies' as described in Gaius' Institutiones arose in legal practice when the heads of the two schools were consulted by two conflicting parties and each gave opposing advice. In order to make their opinions persuasive, the jurists were in need of adequate arguments. For this purpose, they made use of rhetoric and of the argumentative theory of topoi as described in Cicero's Topica.

Download or read book Theory of International Law written by Robert Kolb and published by Bloomsbury Publishing. This book was released on 2016-10-20 with total page 511 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book seeks to analyse various aspects of international law, the link being how they structure and marshal the different forces in the international legal order. It takes the following approaches to the matter. First, an attempt is made to determine the fundamental characteristics of international law, the forces that delineate and permeate its applications. Secondly, the multiple relations between law and policy are analysed. Politics are a highly relevant factor in the implementation of every legal order (and also a threat to it); this is all the more true in international law, where the two forces, law and politics, have significant links. Thirdly, the discussion focuses on a series of fundamental socio-legal notions: the common good, justice, legal security, reciprocity (plus equality and proportionality), liberty, ethics and social morality, and reason.

This book was released on 2004-01-01 with total page 786 pages. Available in PDF, EPUB and Kindle. Book excerpt: "The African Yearbook of International Law" provides an intellectual forum for the systematic analysis and scientific dissection of issues of international law as they apply to Africa, as well as Africa's contribution to the progressive development of international law. It contributes to the promotion, acceptance of and respect for the principles of international law, as well as to the encouragement of the teaching, study, dissemination and wider appreciation of international law in Africa. A clear articulation of Africa's views on the various aspects of international law based on the present realities of the continent as well as on Africa's civilization, culture, philosophy and history will undoubtedly contribute to a better understanding among nations. "The African Yearbook of International Law" plays an important role in examining the tensions underlying the State in Africa, and by shedding more light on the causes of the fragility of African state institutions so as to facilitate the identification of appropriate remedies. The tension and interrelationships among issues such as territorial integrity, self determination, ethnic diversity and nation-building are constantly addressed. Development, human rights and democratization in Africa are also subject of continuous attention and examination.
Download or read book The Roman Collegia written by Jonathan S. Perry and published by BRILL. This book was released on 2017-07-31 with total page 259 pages. Available in PDF, EPUB and Kindle. Book excerpt: This volume maintains that contemporary events, ideologies, and institutions have shaped scholarly work on the ancient Roman collegia, a group of institutions known principally from epigraphic and legal sources. It traces the origins of thinking on the subject from the creation of the Corpus Inscriptionum Latinarum through the political and social movements of the 19th and 20th centuries in Western Europe. The bulk of the book focuses particularly on the intersection of scholarship and economic theory in Fascist Italy, as the collegia were analysed by the Istituto di Studi Romani, incorporated into the Mostra Augustea della Romanità, and ultimately championed by the Minister of National Education, Giuseppe Bottai, in 1939.

This book was released on 2013 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: English summary: In this second edition, the text has been broadened, some notes and paragraphs have been added (27, following chapter II) in order to illustrate the bonum et aequum new source of law, subject of singular importance. The work scheme has remained unchanged, as demanded by the economy for which it was designed, shown in the first edition, as stated in the introduction.
