Book excerpt: The Government's proposals for opening up probation services to competition need further thought, MPs on the Justice Committee have warned in a new report released today. The committee believes that the Government's proposals for payment by results and wider competition in the provision of rehabilitative services are limited because they separate the commissioning of prison places from the commissioning of every other form of sentence provision. They also criticised the very large and incoherent areas used for the tendering of community payback contracts, which they say should not be a model for future commissioning. The report also recommends that probation trusts are given greater freedoms - for example, over the buildings and IT systems they use - and calls on them to focus scarce resources on the frontline. MPs were concerned that frontline probation staff spend three-quarters of their time doing administrative tasks rather than meeting directly with offenders. The committee concluded that the creation of the National Offender Management Service (NOMS), which effectively merged prison and probation services, has not led to an appreciable improvement in the 'joined-up' treatment of offenders; its handling of the community payback tendering exercise has not inspired confidence; and it has not proved itself proficient at running effective national contracts. The MPs are calling on the Government to commission an externally-led review of NOMS. The committee calls for leadership and courage from politicians and sentencers in supporting community sentences and recommends that the Government clarifies to the public what it means by more robust community sentences, and the outcomes they are designed to achieve. Book excerpt: The Criminal Justice Act 2003 introduced a new style of community sentence known as a community order. For offences committee after 1 April 2005, magistrates and judges have been able to tailor communty sentences to the severity of the offence and, at the same time address offending behaviour. The most common order contains a single requirement obliging the offender to complete specified number of unpaid work hours. The National Probation Service supervises all offenders subject to such orders, plus those released from prison on licence or given other sentences to be served in the community. This report examines how well they have been implemented and whether they are meeting sentencing objectives. It is felt the National Probation Service could improve efficiency by increasing the consistency with which community orders are implemented within local Probation Areas. Better data on capacity, costs and the number of orders completed as sentenced would help the Service demonstrate value for money. The report makes several recommendations to this end.

Book excerpt: Since their introduction under the Criminal Justice Act 2003, community orders have offered courts the ability to impose a range of 12 possible 'requirements', including accredited programmes (such as anger management courses or alcohol and drug rehabilitation), unpaid work in the community and supervision by the National Probation Service. There is little information available nationally on the effectiveness of community orders. On the key measure of reconviction, figures from the Ministry of Justice showed that for those sentenced to community orders, their actual reconviction rate was significantly lower than those sentenced to custodial sentences for similar offences. There is, though, no basic information such as national data on whether offenders have completed their community orders, nor on why offenders have failed to complete them. The National Probation Service has set national standards but these are applied inconsistently. The Ministry's current method of funding Probation Areas is unsatisfactory and slow to respond to changes in demand from the courts and it is felt that there is a need for a more flexible system. On the basis of a report by the Comptroller and Auditor General, the Committee examined the Ministry of Justice on increasing effectiveness of community orders; building the confidence of both the court and the community in community orders; improving the funding formula; and tightening adherence to the requirements of orders.

Consistently high re-offending rates have led to the radical overhaul with almost half of all prison-leavers reoffending within 12 months - for those serving less than a year that figure rises to almost 58 per cent. For the first time all offenders, including those serving less than 12 months, will be subject to mandatory supervision and tailored rehabilitation on release from prison. Further plans include: a greater use of mentors to meet offenders at the prison gate and support them in the community; only paying in full for services that are proven to work at reducing re-offending; and opening up rehabilitation services to a much wider range of providers, who are free to innovate and do the things that work to turn offenders' lives around. What we do at the moment is send people out of prison with £46 in their pocket, and no support at all. The proposals will see all of those sentenced to prison or probation properly punished while being helped to turn away from crime for good. They will also mean taxpayers' money is only spent on what works when it comes to cutting crime. These proposals build on a consultation from last year which set out plans to open up rehabilitation services to the private and voluntary sector to drive innovation through the criminal justice system and increase the use of Payment by Results
