Book excerpt: Before the American Revolution, no colony more assiduously protected its established church or more severely persecuted religious dissenters than Virginia. Both its politics and religion were dominated by an Anglican establishment, and dissenters from the established Church of England were subject to numerous legal infirmities and serious persecution. By 1786, no state more fully protected religious freedom. This profound transformation, as John A. Ragosta shows in this book, arose not from a new-found cultural tolerance. Rather, as the Revolution approached, Virginia's political establishment needed the support of the religious dissenters, primarily Presbyterians and Baptists, for the mobilization effort. Dissenters seized this opportunity to insist on freedom of religion in return for their mobilization. Their demands led to a complex and extended negotiation in which the religious establishment slowly and grudgingly offered just enough reforms to maintain the crucial support of the dissenters. After the war, when dissenters' support was no longer needed, the establishment leaders sought to recapture control, but found they had seriously miscalculated: wartime negotiations had politicized the dissenters. As a result dissenters' demands for the separation of church and state triumphed over the establishment's efforts and Jefferson's Statute for Establishing Religious Freedom was adopted. Historians and the Supreme Court have repeatedly noted that the foundation of the First Amendment's protection of religious liberty lies in Virginia's struggle, turning primarily to Jefferson and Madison to understand this. In Wellspring of Liberty, John A. Book excerpt: Born in the village of Llangeinor, near Bridgend in south Wales, Richard Price (1723–91) was, to his contemporaries, an apostle of liberty, an enemy to tyranny and a great benefactor of the human race. His friend Benjamin Franklin described aspects of his work as ‘the foremost production of human understanding that this century has afforded us’. A supporter of the American and French Revolutions, Price corresponded with the likes of Jefferson, Adams, Washington, Mirabeau and Condorcet. In November 1789 he publicly welcomed the start of the French Revolution and thus inspired not only Edmund Burke to write his rebuttal in Reflections on the Revolution in France, but also the Revolution Controversy, ‘the most crucial ideological debate ever carried on in English’. Price also brought to world attention the Bayes-Price Theorem on probability, which is the invisible background to so much in modern life, and wrote a fundamental text on moral philosophy. Yet, despite all this and more, he remains little-known beyond academia, a situation that this biography helps to rectify. Liberty’s Apostle tells his life story through his published works and, fully for the first time, his now published correspondence with a host of eighteenth century celebrities. The life revealed is of a truly remarkable Welshman and, as Condorcet remarked, of ‘one of the formative minds’ of the eighteenth century Enlightenment.

The work as a whole is cumulative, with only slight, albeit significant, differences in the kinds of information which may be found in one volume versus another. Volume I of this work contains the records of hundreds of Revolutionary War soldiers and officers of Georgia, with genealogies of their families, and lists of soldiers buried in Georgia whose graves have been located. Volumes II and III are also published by Clearfield Company. The arrangement of Volume II is similar to that of Volume I; however, it contains records of officers and soldiers not only from Georgia but from other states, many of whose descendants later came to Georgia because of liberal land grants. Volume III, the longest of the work, is similar in scope to Volume II except that the majority of the entries are for Georgia officers and soldiers, with only some material relating to other states. The three volumes, each of which is indexed, refer to as many as 20,000 persons overall.

Book excerpt: This book discusses the revolutionary broadening of concepts of freedom of press and freedom of speech in Great Britain and in America in the late eighteenth century, in the period that produced state declarations of rights and then the First Amendment and Fox's Libel Act. The conventional view of the history of freedoms of press and speech is that the common law since antiquity defined those freedoms narrowly, and that Sir William Blackstone in 1769, and Lord Chief Justice Mansfield in 1770, faithfully summarized the common law in giving a very narrow definition of those freedoms as mere liberty from prior restraint and not liberty from punishment after something was printed or spoken. This book proposes, to the contrary, that Blackstone carefully selected the narrowest definition that had been suggested in popular essays in the prior seventy years, in order to oppose the growing claims for much broader protections of press and speech. Blackstone misdescribed his summary as an accepted common law definition, which in fact did not exist. A year later, Mansfield inserted a similar definition into the common law for the first time, also misdescribing it as a long-accepted definition, and soon misdescribed the unique rules for prosecuting sedition as having an equally ancient pedigree. Blackstone and Mansfield were not declaring the law as it had long been, but were leading a counter-revolution about the breadth of freedoms of press and speech, and cloaking it as a summary of a narrow common law doctrine that in fact was nonexistent. That conflict of revolutionary view and counter-revolutionary view continues today. For over a century, a neo-Blackstonian view has been dominant, or at least very influential, among historians. Contrary to those narrow claims, this book concludes that the broad understanding of freedoms of press and speech was the dominant context of the First Amendment and of Fox's Libel Act, and that it enjoyed greater historical support.
