In The Collapse of Freedom of Expression, Jordi Pujol explores both the modern concept of the freedom of expression based on the European Enlightenment and the deficiencies inherent in this framework. Modernity has disregarded the traditional roots of the freedom of expression drawn from Christianity, Greek philosophy, and Roman law, which has left the door open to the various forms of abuse, censorship, and restrictions seen in contemporary public discourse. Pujol proposes that we rebuild the foundations of the freedom of expression by returning to older traditions and incorporating both the field of pragmatics of language and theological and ethical concepts on human intentionality as new, complementary disciplines. Pujol examines emblematic cases such as Charlie Hebdo, free speech on campus, and online content moderation to elaborate on the tensions that arise within the modern concept of freedom of expression. The book explores the main criticisms of the contemporary liberal tradition by communitarians, libertarians, feminists, and critical race theorists, and analyzes the gaps and contradictions within these traditions. It discusses the distinguishing and opposing pathologies produced by globalization: unlimited individualism or self-obsession, manifested as (Promethean) omnipotence and (narcissistic) indifference, and endogamous communitarianism or an ‘us’-obsession that results in conflict and violence. The polarization between a lack and an excess of pathos is reflected in the distorted forms taken on by fear. The book advocates a metamorphosis of fear, which may restore in the subject an awareness of vulnerability and become the precondition for moral action. Such awareness and the recognition of the condition of contamination caused by the other’s unavoidable presence teach us to fear for rather than be afraid of. Fear for the world means care of the world, and care, understood as concern and solicitude, is a new notion of responsibility, in which the stress is shifted to a relational subject capable of responding to and taking care of the other. From a global perspective, the proposed vision of care also compels us to explore a new paradigm of justice.

Historically, most liberal democracies have developed on the basis of national cultures – either a single one, or a dominant one, or a federation of several ones. However, political and economic developments have upset traditional patterns and have blurred established boundaries. Ongoing immigration from diverse origins has inserted new ethnic minorities into formerly homogenous populations. Democratic liberties and rights provided opportunities for old and new marginalized minorities to resist assimilation and to assert identities. The resulting pattern of multiculturalism is different from earlier ones. Often cultural boundaries are neither clearly defined nor do they simply dissolve by assimilation into a dominant group – they have become fuzzy and a constant source of real or imagined hostility and anxiety. A proliferation of mixed identities goes together with stronger claims for cultural rights and escalating hostilities between ethnic minorities and national majorities. In many countries multiculturalism is today perceived as a challenge rather than as an enrichment. The book focuses on the question how institution and policies of liberal democracies can cope with these trends. The book addresses two tasks: 1) To compare different national contexts and types of ethnic groups (immigrant and indigenous, linguistic and religious minorities) and to discuss how policies of multicultural integration have to be adapted in order to cope with such differences. 2) To evaluate the impact of common rends of globalization which link societies and encourage convergence between national models of multicultural integration.
