Book excerpt: This book explores how law and policy makers within the Southern African Development Community regional structure might reform the legal and regulatory frameworks to best capitalise the benefits of the movement of people, drawing lessons from other experienced jurisdictions by critically engaging with the regulatory efforts and approaches in regions such as the European Union, the Economic Community of West African States, and the East African Community to propose a revised approach to migration governance and practice in the SADC. Deeper regional integration allows citizens to move freely across national boundaries, and services are a rising component of global trade and investment. However, global trade in services is stifled by barriers at and behind the border. These barriers make it difficult for service providers from developing regions to access key markets in their preferred modes of service trade. Against this background, this book aims to take the discussion on furthering regional integration and trade through the movement of people by tackling issues on stringent immigration policies, arguing that having a vibrant and rewarding trade in services will require an approach towards the unrestricted movement of persons.

Book excerpt: This study focuses on the need to harmonise the law of international sale within the SADC region in order to facilitate international trade with the aim of fostering regional integration, economic development and alleviating poverty. This study addresses the mechanisms by which such harmonisation could be achieved by analysing three models which have been selected for this purpose, namely the CISG, the OHADA and the proposed CESL. The main issues addressed include whether SADC Member States should adopt the CISG, join OHADA, emulate the CESL or should use any of the other instruments as a model for creating a harmonised sales law for SADC. In conclusion, it is observed that SADC has its own institutional and operational mechanisms that require a process and instrument tailor-made for the unique needs of the region. It is recommended that SADC should create its own common sales law based on the CISG but taking into account lessons learnt from both the OHADA system and the CESL. A number of legislative, institutional and operational transformative and reform mechanisms are recommended to enable the creation of such a community law and ensure its uniform application and interpretation. Book excerpt: Despite the significant growth and opportunities in trade in services, countries remain reluctant to open key service industries to unfettered competition, and regulations continue to restrict or even prevent international trade in this sector. In the Southern African Development Community (SADC) region, the service sector accounts for an increasing share of gross domestic product (GDP) and employment, but in many countries and subsectors, service firms are uncompetitive and inefficient when compared to their peers. Trade agreements can provide an external stimulus and some incentive for SADC member states to engage in services liberalisation. They may also be used to source additional expertise and resources to support domestic regulation and reform. The draft EU-SADC Economic Partnership Agreement (EPA) has the ability to take SADC countries forward in committing them to good practices and policies in a number of critical services subsectors. However, it is clearly driven by EU trade and regulatory interests. The draft SADC Protocol on Trade in Services is much less ambitious and, in its current form, is unlikely to stretch member states beyond their existing General Agreement on Trade in Services commitments. There is therefore some risk that the SADC Free Trade Agreement will be overtaken by the EPA; and that any impetus for change will come instead from an agreement crafted by Europe. The paper begins with a review of the role of the service industry in the SADC economy, focusing on its GDP, employment, trade and investment. It identifies three major sectors for illustrative evaluation, namely transportation, financial and telecommunications services. The paper briefly considers the state of competition and regulation across SADC in these sectors. It looks at the proposed EPA and SADC services agreement and concludes with a discussion on the likely implications of these negotiations.

The four basic research questions for the study were as follows: Is there informal cross-border trade among the mainland SADC member states? Do the informal traders (ICBTs) contribute to the SADC national economies and to the economies of the region as a whole, and is this revenue acknowledged by the SADC nation governments? Does the ICBT facilitate the new mission of SADC: the promotion of social, economic and political integration in the Southern African region? Lastly and perhaps most importantly have the SADC member states or SADC as an organisation formally put in place trade policies and regulations that promote the development of ICBT in the region? The study further explores the extent to which the cross-border ethnic relationships of ICBTs assist and facilitate the activities of the informal cross-border micro-trade. These questions are investigated within the context of SADC, a regional grouping with a long geo-political history as well as common colonial and socio-economic experiences that have all impacted on and restrained formal trade among SADC member states.

Book excerpt: This book provides a thorough and rigorous discussion on the impact of trade liberalisation on economic development with a special focus on the African continent. The author presents the rationale for trade liberalisation, trade liberalisation frameworks, the trade liberalisation economic development nexus, impediments to trade, and contemporary issues of international trade. In this book, notwithstanding the benefits from trade liberalisation, the author shows that African trade as a share of global trade has remained flat at 3% as in 1975, while the continent’s exports have remained raw materials and its intra-regional trade at less than 15% of total trade, which is the lowest in the world (UNCTAD, 2020). With respect to key economic development indicators such as economic growth, poverty levels, and employment levels, this book shows that, ironically and in direct contrast with the conventional views that trade liberalisation alleviates poverty, trade liberalisation in Africa has resulted in high levels of unemployment and low economic growth which ultimately lead to increased poverty. In addition, this book provides a detailed analysis of why trade liberalisation has failed to yield meaningful benefits to Africa. The binding constraints and blockages which prevent positive spin-offs on trade liberalisation in Africa are discussed in detail in this book. In the same vein, the author provides practical strategies which must be adopted by African countries in order to gain from trade liberalisation, making this work a must-read for African governments, academia, trade experts, regional trading blocs, the World Trade Organization, and development partners. In view of this, and as part of the disruptive and structural transformation policies, the author discusses case studies and international experience contextualised to Africa as well as strategies for addressing the trade-related infrastructure gap, production capacities, export promotion, and aid for trade.

This edition examines the growth of regional trade agreements, which have risen eight-fold in two decades with currently, as much as 40 percent of global trade taking place among countries that have some form of reciprocal regional trade agreement. Issues discussed include: regional trading trends; effects of regional agreements on trade creation, trade facilitation and services, investment, intellectual property rights, and labour mobility; whether the proliferation of agreements poses risks for multilateral trading system, and if so, options for managing them. The report finds that agreements leading to open regionalism (that is, deeper integration of trade as a result of low external tariffs, increased services competition, and efforts to reduce cross-border and customs delays costs) are effective as part of a larger trade strategy to promote growth. Although regional agreements can prove beneficial to member countries, they can have adverse effects on excluded countries, and the lowering of border barriers around the world is crucial to minimising these effects. The completion of the Doha Development Agenda by all WTO countries will reduce the risk of trade diversion associated with regional agreements and will decrease trade losses of countries excluded from agreements.

Regional trade blocs are formed by neighbouring countries or countries that are in close proximity to each other. The two key features of a trade bloc is that (1) it involves a cutback or abolition of obstacles to trade, and (2) the trade liberalisation that is attained through the trade bloc is discriminatory in purview of the fact that it is applicable only to the member states of the trade bloc and non-member countries are shown prejudice in their dealings with members of the trade bloc. The first aspect of trade blocs above is in line with the mission of the World trade Organisation (WTO) and its antecedent, the General Agreement on Tariffs and Trade (GATT). The principle of Non-discrimination under the GATT stipulates that no member state shall show prejudice between GATT members during the operations of world trade. In the same magnitude, the WTO offers an environment for negotiating agreements that are focused on reducing barriers to international trade and making sure that trade is carried out on a basis of openness, thus contributing to economic growth as well as development. Notably, although trade blocs have different structures, they are premised on the same objective, that is, to lessen trade barriers among member states. The second aspect of trade blocs however seems to be in conflict with the motive of the GATT/WTO system. The preamble of the GATT is very clear on promoting non-discrimination in international trade by reinforcing the need for reciprocal and equally advantageous arrangements focused on substantial cutbacks in tariffs and other obstacles to trade and to the abolition of discriminatory treatment in international trade. Equally, under the WTO as well as under its predecessor, the GATT, trade discrimination is promoted through the use of the principles of the Most-Favoured-Nation (MFN) that requires treatment of other people equally as pertains to trade and the principle of National Treatment which stipulates that foreigners and locals should be treated equally in trade matters. Its ratification is expected in the near future and therefore the question arises in how far the creation of the free trade area will affect the patterns of intraregional trade. After an examination of the framework of preferential and free trade agreements in the region this study employs a customised methodology based on Viner's theory of customs unions in order to identify those areas of trade that will be affected by trade creation or trade diversion effects. I have examined the trade creation and trade diversion potential of the most relevant goods for each of the twelve SADC countries, resolved to a 2 digit HS code level. These results were then put into relation to the overall macroeconomic situation in each country. There were a number of data problems that make the findings of this study less meaningful. However, to some extent this report can be seen as a best possible approximation and as a starting point for further and more detailed research. The overall findings can be summed up as follows: · South Africa is not going to be the only winner from the free trade area and especially its textile and clothing sector might suffer as a result. · There are virtually no trade creation and trade diversion effects to be expected for the BLNS countries but there is a good possibility of additional exports. Therefore, they are likely to profit the most. · Angola and Mozambique will probably experience the strongest trade creation and trade diversion effects. This will be triggered mainly by free trade with South Africa and the fact that their industrial base is very weak and has just started recovering.
