Mais le seul fait qu'elle acquière droit de cité au détriment de "divorce et séparation", de "mari et femme", de "relations domestiques", et de ces innombrables regroupements empiriques caractéristiques de l'organisation de la common law, est symptomatique d'un rapprochement avec les systèmes dits romano-germaniques. La famille est aussi l'une des institutions juridiques qui a connu le plus de transformations au cours du dernier demi-siècle. Ces transformations sont de celles dans lesquelles le droit ne précède certainement pas l'évolution des mœurs. Certains estiment cependant qu'un reflux par rapport à certains mouvements ne manquera pas de se produire - s'il n'est pas déjà amorcé - en application des vieux principes de la dialectique, de l'action et de la réaction. Donald Poirier a choisi, précisément en raison de la dynamique qui caractérise présentement l'objet de son propos, de se situer résolument dans une perspective historique par rapport à la common law que l'on est tenté d'appeler traditionnelle. Mais il a également eu le souci de suivre de près l'actualité législative et jurisprudentielle afin de montrer que nous sommes loin d'avoir atteint un état stable.
