Available in PDF, EPUB and Kindle. Book excerpt: The Water Quality Act (WQA) of 1987 added section 402(p) to the Clean Water Act (CWA). Section 402(p) of the CWA requires the Envrionmental Protection Agency (EPA) to establish phased and tiered requirements for storm water discharges under the National Pollutant Discharge Elimination SYstem (NPDES) program. On August 16, 1991 (56 FR 40948), EPA requested public comments on several regulatory and policy issues regarding NPDES permits for storm water discharges associated with industrial activity. On November 5, 1991 (56 FR 56549), the Agency also proposed extending the deadline for submitting part 2 of group applications for storm water discharges associated with industrial activity. In response to comment received on August 16, 1991, proposal, today's action describes a National Strategy for issuing NPDES permits for storm water discharges as associated with industrial activity. Today's action also contains a final rule that revises minimum NPDES monitoring requirements for storm water discharges associated with industrial activity. In addition, today's rule establishes minimum requirements for filing notices of intent to be authorized to discharge under NPDES general permits. Today's rule also establishes a deadline of October 1, 1992 for part 2 of group applications for storm water discharges associated with industrial activity. As noted above, this revised deadline was proposed on November 5, 1991. In connection with group applications, today's rule contains an amendment to clarify the minimum number of facilities that must submit sampling information in part 2 of a group application. Finally, today's action codifies several provisions of Section 1068 of the Intermodal Surface Transportation Efficienty Act into the NPDES regulations. Section 1068 of the Transportation Act addressed permit application deadlines for stor water discharges associated with industrial activity from facilities that were owned or operated by municipalities.

By modernizing this Clean Water Act reporting program, permittees and regulators will use existing, available information technology to electronically report information and data related to the NPDES permit program. This regulation will help provide greater clarity on who is and who is not in compliance and enhances transparency by providing a timelier, complete, more accurate, and nationally-consistent set of data about the NPDES program. By providing improved data in a more accessible form, this final rulemaking will improve the ability of EPA and authorized NPDES programs to target the most serious water quality and compliance problems. Furthermore, by reducing the time and resources devoted to outdated data management activities, the rule could allow authorized NPDES programs to shift limited resources to important water quality and public health protection activities. The transition from paper to electronic reporting will require close coordination and cooperation between EPA and authorized NPDES programs. This regulation provides important flexibility while still implementing electronic reporting in a timely and effective fashion. Book excerpt: On April 23, 2020, the United States Supreme Court issued a significant decision regarding when National Pollution Discharge Elimination System (NPDES) permits are needed for “point source” discharges under the Clean Water Act. The Clean Water Act forbids “any addition” of any pollutant from “any point source” to “navigable waters” without an appropriate permit from the United States Environmental Protection Agency (EPA).The Supreme Court's decision stemmed from a citizens' lawsuit filed by several environmental groups against the County of Maui, Hawaii. Maui operates a wastewater reclamation facility that collects sewage from the surrounding area, partially treats it, and pumps the treated water through four wells hundreds of feet underground. This effluent, which amounts to about four million gallons a day, then travels approximately one-half mile through groundwater to the Pacific Ocean. The environmental groups claimed that Maui has been discharging a pollutant to “navigable waters,” namely, the Pacific Ocean, without an NPDES permit required by the Clean Water Act.

Book excerpt: The National Pollutant Discharge Elimination System (NPDES) Compliance Inspection Manual has been developed to support personnel that conduct NPDES inspections of wastewater treatment plants, storm water industrial and construction sites, pretreatment facilities, biosolids handling and treatment facilities, Concentrated Animal Feeding Operations (CAFOs), municipal wastewater collection systems (combined and separate from storm water) as well as pollution prevention and multimedia concerns. These procedures are fundamental to the NPDES compliance program and provide inspectors with a method for conducting inspections. The manual presents standard procedures for inspections. Three objectives should be met during a routine compliance inspection. According to this section, the inspection should be performed in a manner designed to: Determine compliance status with regulations, permit conditions, and other program requirements, Verify the accuracy of information submitted by permittees, Verify the adequacy of sampling and monitoring conducted by the permittee. Other purposes of compliance inspections include: Gathering evidence to support enforcement actions, Obtaining information that supports the permitting process, Assessing compliance with orders or consent decrees.

In response, today's notice requests information and public input on Phase II of the national storm water program mandated under section 402(p)(6) of the Clean Water Act (CWA). More specifically, EPA is today requesting public comment on a number of issues including scope of coverage under Phase II, identification of high risk Phase II discharges, alternative control strategies, and appropriate deadlines. With respect to each of these issues, the Agency is requesting input on how to meet envirionmental objectives and requirements set forth under section 402(p)(6) while at the same time identifying cost-effective control strategies that minimize the economic impact on the regulated community as well as the administrative burden on Federal, State, and local government.
