In general, the committee finds that the process went well, but it also suggests some practical improvements and clarifications. Among the key findings is that clearer guidance is still needed on the circumstances under which a Prime Minister should resign and when he has a duty to remain in office. The report also proposes enhanced processes for ensuring that governments understand-and are discouraged from breaching-restrictions on their activity that apply before and immediately after general elections. The committee concludes that as a coalition government's programme for government cannot be put directly to the people, the House of Commons needs to have the opportunity to subject these proposals to full pre-legislative scrutiny.

Book excerpt: Opinion polling has consistently indicated the likelihood of an election result with no overall majority. This means it is likely there will be a negotiation period for the formation of a potential coalition Government or a Government supported on a confidence and supply arrangement. This inquiry was to provide guidance to the public on what to expect in the government formation process in a Parliament with no overall majority. The key issues are that: the negotiation period in 2015 is likely to be longer than in 2010; a Prime Minister who is unlikely to be able to form a new administration is nevertheless likely to remain in office until it is clear that another administration can form a Government which can command the confidence of the House of Commons; if there is no parliamentary majority to support the current administration, it will nevertheless continue in office on a caretaker basis until a new government is formed. The Committee believes it is wrong that Parliament may not have its first meeting after the election until after a new administration has been appointed. They consider that it is wrong in principle that the decision on the date of Parliament's return should be in the hands of the Prime Minister, and recommend that the date of Parliament's first meeting after a General Election should be put on a statutory basis. Parliament should return as soon as possible, and in any case the Prime Minister should set the date for Parliament's return following the General Election for Monday 11 May 2015.

Should the next Government plan to take forward constitutional reform, a select committee be established to examine the Government's proposals, to keep the progress of any political and constitutional reform under regular review, and to continue the work this Committee has undertaken. The Committee has also highlighted the extent to which it has engaged the public with it's work through consultations and increased use of social media, online surveys and informal events. This public engagement is one of it's greatest innovations, and something which it encourages other committees to adopt in the future

Under parliamentarism, the government comes from, and remains responsible to, the national parliament. Yet, although legislatures and the politics of government formation are two of the most studied phenomenon in comparative politics, relatively little attention has focused on the degree to which parliamentary rules and procedures impact government formation. For instance, exactly what does 'come from parliament' mean in the context of government formation? To answer this question, the volume seeks to 'unpack' the parliamentary investiture vote. Investiture consists of a vote in parliament to demonstrate that an already formed or about to be formed government has legislative support. The volume analyses investiture along six dimensions: (1) the number of chambers involved in government formation, (2) the exact topic of any investiture vote - for example whether the votes focuses on one or more of the prime ministership, the cabinet and/or the government's policy program, (3) the sequencing and timing of the vote in the overall game of government formation, (4) the decision rule - for example absolute majority, simple or some form of negative parliamentarism, (5) the number of rounds provided for, and (6) what happens in the event of a failure to invest a government. Each of the 16 case studies, written by leading scholars of legislative politics in their respective polities, seeks to describe the institutional rules and practices and analyse their origins and consequences. These case studies are supplemented with two comparative chapters.

Its development was first announced in February 2010, when, in a speech to the Institute for Public Policy Research, the then Prime Minister, Gordon Brown, stated that he had asked the Cabinet Secretary, Sir Gus O'Donnell, "to lead work to consolidate the existing unwritten, piecemeal conventions that govern much of the way central government operates under our existing constitution into a single written document." The concept of a Cabinet Manual appears to have drawn extensively upon experience in New Zealand. The full draft of the Manual (incorporating a revised version of the chapter on elections and government formation) was published with the agreement of the new Prime Minister, David Cameron, and the Deputy Prime Minister, Nick Clegg, and after its text had been approved by the Cabinet following consideration by the relevant Cabinet sub-committee and was made subject to public consultation. The Cabinet Secretary has stated that he expects to invite Cabinet to endorse a revised version of the Cabinet Manual in the spring of 2011. This report forms the Select Committee on the Constitution's response to the consultation. It is also intended to inform Members of the House about the issues which arise from the Manual's publication.

Book excerpt: Whilst welcoming the motivation behind the Manual and the transparency it brings to the workings of Government, the Committee says that in practice the Manual may be treated as having greater authority than originally intended, particularly where its content extends beyond matters purely for the Executive. All the work of the Executive, including the Cabinet Manual , is subject to scrutiny by Parliament. The fact that the document is primarily directed at the Executive does not exempt it from this scrutiny. The Committee makes some practical suggestions for specific improvements to the text, focusing particularly on the chapters covering government formation and ministers and Parliament. The Committee also challenges some of the specific content of the draft: the failure to include the convention, acknowledged elsewhere by the Government, that Parliament should have the opportunity to debate decisions to commit troops to armed conflict; guidance on when a Prime Minister should resign following a hung Parliament. The Committee recommends that the House should hold a regular debate on the Manual. The Committee felt, despite dissatisfaction with parts of the original draft, there was no reason to delay production of an approved version. The new version need not be perfect as it will be subject to further review.

Book excerpt: The Committee supports the aims of increasing transparency in lobbying and effectively and fairly regulating third-party campaigning, but finds that the Government's bill is seriously flawed, because of inadequate consultation and a lack of pre-legislative scrutiny. Moreover, the definition of "consultant lobbying" is so narrow that not only would it exclude in-house lobbyists, which was the Government's intention, but it would also exclude the vast majority of third-party lobbyists and particularly the larger organisations. Many companies undertake lobbying as part of a wider communications and public relations business, and they spend very little of their time meeting directly with Ministers and Permanent Secretaries, meaning they could argue they were exempt from registering. The register should be expanded to include in-house lobbyists, and to cover the provision of advice on lobbying, as well as direct contact with Ministers and Permanent Secretaries. Special Advisers and Senior Civil Servants should be included in the list of people with whom contact counts as lobbying. Part 2 of the Bill, on non-party campaigning, and particularly the definition of spending "for electoral purposes" is confusing. The Committee urges the Government temporarily to withdraw the Bill and support a motion in the House to set up a special committee to carry out pre-legislative scrutiny, using the text of the existing Bill as a draft. The special committee should be charged with producing an improved Bill within six months.

Book excerpt: The Committee has produced its own code, included in this report, for relations between central and local government. The code is intended to replace the estimated 1,293 duties imposed on local government today. The Committee concludes that the balance of power between central and local government is skewed in favour of the centre and needs to be addressed. The devolution of power to Scotland, Wales, and Northern Ireland has been successful and is an evolving process - there is no apparent reason why local government in England is not capable of using similar powers. Power and finance must go together, if local government is to become an equal partner it should have own source of revenue. Local authorities in England could also have a share of the existing income tax take and local councils freed to raise additional revenue, with the consent of their electorates. English local government lacks some of the most basic constitutional protections that are available to some of its counterparts in a number of other mature European democracies. The Government should examine the possibilities of a stronger constitutional status for local government, through an entrenched statutory code, or a similar proposal. A code for relations between central and local government, enforced by statute, could be beneficial to both tiers of government for several reasons. First, it could help set out exactly where powers do, and should, lie, thereby increasing transparency for the electors. Secondly, it could help redress the overcentralisation of England. Thirdly, it could provide an economic boost that the country sorely needs.
