Book excerpt: Alors que le hashtag #MeToo a permis de prendre conscience du nombre de violences sexuelles commises, de nombreuses voix s’élèvent pour critiquer le mauvais traitement des victimes par les institutions judiciaires et policières. Ce mauvais traitement peut être une source de victimisation secondaire : il donne parfois le sentiment d’être une seconde fois victime, mais cette fois-ci d’un préjudice causé par la Justice elle-même. Cet ouvrage entend montrer que le risque de victimisation secondaire est inhérent au droit et concerne potentiellement toute victime qui souhaiterait saisir la justice. Le système juridique a toutefois connu des récentes évolutions visant à améliorer la prise en compte des victimes, mais qui ne permettent pas une véritable protection. Ainsi, aujourd’hui, malgré les encouragements, voire les injonctions, faites aux victimes de dénoncer les faits qu’elles ont subis, la voie judiciaire demeure toujours une voie risquée, dangereuse.

Forte du témoignage de près de quatre-vingts interlocuteurs, des magistrat·e·s, des avocat·e·s, des policier·e·s, mais aussi des femmes et des hommes de tous les milieux sociaux, protagonistes d'affaires médiatisées (Gérald Darmanin, Luc Besson, Roman Polanski...) ou pas, l'autrice pointe les obstacles que rencontrent ces dossiers et mesure, sur le terrain, l'impact des politiques affichées. Chemin faisant, elle contrecarre les arguments de ceux qui dénoncent opportunément un « tribunal médiatique » et crient à la « chasse à l'homme », mais montre aussi les limites de ce que peut la justice. Ainsi au fil de chapitres qui font alterner coulisses de l'enquête et récits poignants, c'est bien le système dans son entier qu'elle nous dévoile. Il appartient à toutes et à tous, ensuite, de le changer.

Book excerpt: Ce mémoire se veut une étude exploratoire portant sur les sens de justice attribués selon les victimes de violences sexuelles ayant participé à un mouvement de dénonciation numérique. La présente étude tente de compléter les connaissances déjà présentes sur les mouvements de dénonciation numérique en explorant les perceptions des victimes ayant participé au mouvement. Plus précisément, l'objectif principal est de comprendre l'influence, s'il a lieu, entre les perceptions du système de justice, la participation à un mouvement de dénonciation numérique ainsi que les sens donnés au concept de justice dans sa pluralité. La théorie tridimensionnelle de la justice par Nancy Fraser est utilisée comme cadre théorique. Les résultats de la présente étude sont analysés en considérant les différents types de justice élaborés par Fraser soit les notions de reconnaissance, de distribution et de représentation politique. Étant basé sur une méthodologie qualitative et à l'aide d'entrevue semi-dirigée, huit personnes furent rencontrées. L'analyse des résultats de notre étude permet d'explorer, d'abord 1) la perception et les motivations des répondants face à la dénonciation numérique des violences sexuelles; ensuite, 2) les attentes et les obstacles face à la dénonciation judiciaire en matière de violences sexuelles et, enfin, 3) les sens de considération, de sécurité et d'empowerment attribués à la justice par les répondants. Les résultats permettent de mieux comprendre l'utilisation des médias sociaux et de percevoir que l'utilisation des mouvements de dénonciation numérique semble ne pas représenter une substitution au système de justice pénale. Notamment, les deux espaces de dénonciation comprennent des distinctions, mais aussi des similarités qui peuvent répondre à différents besoins des victimes à ce qui a trait à la dénonciation des violences sexuelles.

Intimate partner violence and sexual coercion are the most common forms of GBV, and these are the types of GBV that they analyze. GBV has serious consequences for women's health and well-being, ranging from fatal outcomes, such as homicide, suicide, and AIDS-related deaths, to nonfatal outcomes, such as physical injuries, chronic pain syndrome, gastrointestinal disorders, complications during pregnancy, miscarriage, and low birth-weight of children. GBV also poses significant costs for the economies of developing countries, including lower worker productivity and incomes, and lower rates of accumulation of human and social capital. The authors examine good practice approaches in justice, health, education, and multisectoral approaches. In each sector, they identify good practices for: (1) law and policies; (2) institutional reforms; (3) community-level interventions; and (4) individual behavior change strategies.

Book excerpt: This report of the President's Commission on Law Enforcement and Administration of Justice -- established by President Lyndon Johnson on July 23, 1965 -- addresses the causes of crime and delinquency and recommends how to prevent crime and delinquency and improve law enforcement and the administration of criminal justice. In developing its findings and recommendations, the Commission held three national conferences, conducted five national surveys, held hundreds of meetings, and interviewed tens of thousands of individuals. Separate chapters of this report discuss crime in America, juvenile delinquency, the police, the courts, corrections, organized crime, narcotics and drug abuse, drunkenness offenses, gun control, science and technology, and research as an instrument for reform. Significant data were generated by the Commission's National Survey of Criminal Victims, the first of its kind conducted on such a scope. The survey found that not only do Americans experience far more crime than they report to the police, but they talk about crime and the reports of crime engender such fear among citizens that the basic quality of life of many Americans has eroded. The core conclusion of the Commission, however, is that a significant reduction in crime can be achieved if the Commission's recommendations (some 200) are implemented. The recommendations call for a cooperative attack on crime by the Federal Government, the States, the counties, the cities, civic organizations, religious institutions, business groups, and individual citizens. They propose basic changes in the operations of police, schools, prosecutors, employment agencies, defenders, social workers, prisons, housing authorities, and probation and parole officers.
