Book excerpt: Le droit est un ensemble de règles de conduites qui, dans une société donnée, régissent les rapports entre les hommes. Le droit à la protection de la santé occupe une place privilégiée dans la hiérarchie des normes, puisqu’il est clairement énoncé dans le préambule de la Constitution de 1946. Les normes juridiques produites peuvent être sources d’obligation ou de devoirs. Il semble ainsi légitime pour les professionnels de santé publique d’utiliser le vecteur juridique comme un moyen d’action en faveur de la santé de tous. Cependant l’outil juridique connaît des limites notamment liées à l’espace, à l’économie, ou aux individus. Il existe ainsi des zones où la protection de la santé est inefficace mettant en jeu la santé de chacun. Le développement des contraintes juridiques sur les individus soulève de nombreuses interrogations car il touche au corps et aux comportements individuels. Ces contraintes juridiques visent à responsabiliser les acteurs. Elles nécessitent cependant l’adhésion de tous afin de limiter les résistances et les comportements de contournement. En tant que bien public, les questions de santé nécessitent ainsi un débat public et une adhésion collective au travers du processus de décision démocratique. Le rôle du spécialiste de santé publique est ainsi d’informer les citoyens, les professionnels et les entreprises de l’état de santé de la population et des mesures susceptibles d’y remédier. Cette démarche doit ainsi permettre à la « Nation » de définir ses priorités, en fonction des informations dont elle dispose, et de déterminer ses orientations afin d’y adhérer le plus largement possible

Book excerpt: Platform work – the matching of the supply of and demand for paid labour through an online platform – often depends on workers who operate in a “grey area” between the archetype of an employee and a self-employed worker. This important book explores the utility of the International Labour Organization’s existing standards in governing this phenomenon. It indicates that despite their relevance, many standards have little or no impact. The standards apply to the issue but they fail to connect with it. The author shows how three ILO conventions – the Home Work Convention, 1996 (No. 177), the Private Employment Agencies Convention, 1997 (No. 181), and the Domestic Workers Convention, 2011 (No. 189) – can be revitalised to have an impact on the platform work debate. In the course of the analysis he responds in depth to such questions as the following: What are digital labour platforms? What does decent work mean? Did the ILO centenary fundamentally change anything? What is the link between private employment services and platform work? How do crowdworkers relate to homeworkers and teleworkers? Are platform workers engaged in domestic work? What form could a future ILO standard on platform work take? Given that the ILO plans to start discussions on a potential future standard for platform work in 2022, this book will prove very useful in highlighting the issues and standards that such discussions should consider. Research has shown that the techniques and tools of the platform economy have spread far beyond gig work, resulting in widespread “gigification” and restructuring of workplace behaviours and relationships, jobs, and communities across the world. For this and other reasons, including the book’s detailed analysis of issues not addressed elsewhere, labour lawyers, in-house counsel, researchers, and policymakers will gain valuable insight into what decent work in the platform economy would require, thus greatly broadening the discussion on this difficult-to-regulate phenomenon.

Actuellement, la physionomie de cette relation s'est fondamentalement modifiée. L'acteur passif qu'était le malade est devenu un interlocuteur actif, revendiquant sa qualité juridique de consommateur. De plus, le colloque, initialement singulier, est devenu plural. Entre le médecin et le malade, ou patient, divers éléments s'interposent maintenant (chaîne d'intervenants multiples, contexte économique, législateur, pouvoirs publics, source jurisprudentielle) et ont fait irruption dans la relation. Si les deux acteurs initiaux se retrouvent finalement face à face, d'autres partenaires vont fortement influer sur les rapports entre le médecin et le malade. Il appartiendra cependant au praticien de prendre seul la décision qui engage sa responsabilité vis à vis de son patient. Mais cette décision l'engage également, par de multiples liens, envers les autres éléments du système. Il demeure "libre" de décider, mais ses choix doivent s'inscrire dans une épure normative de plus en plus contraignante. De plus, le résultat de cette décision n'est plus qu'une proposition de soins présentée au patient qui seul, mais après une parfaite information et en collaboration avec le professionnel, prendra in fine les résolutions qu'il jugera utile pour sa santé. Ainsi est institutionnalisé un régime de codécision qui vise à remplacer la relation paternaliste si décriée. Cette nouvelle disposition, d'origine législative, permet de penser que le patient, devenu participant actif de la relation médicale, prend à son compte une partie de la responsabilité, celle du risque encouru, dont il a été dûment informé préalablement et qu'il a accepté en toute connaissances de cause.

They are often applied in varying degrees in various legal systems to a rather wide range of contract cases when certain issues arise issues such as abuse of rights, unfairness, good faith, fairness of duty or loyalty or honesty, duty of care, and other such contract terms not lending themselves readily to clear or permanent definition. Here for the first time is a systematic discussion of this kind of rule in the evolving and dynamic context of European contract law. A collection of twelve insightful essays by leading European law authorities, the book is based on a conference organized jointly by the Society of European Contract Law (SECOLA) and l'association Henri Capitant, held in the `grande salle' of the French Supreme Court in Paris in 2005. The subject is approached along three distinct but interconnected avenues: comparative contract law, in which the different models to be found among Member States particularly the Germanic, French, and English common law systems are explored with an eye to differences and common ground;EC contract law, in which the general clause approach has tended to focus on labour law and consumer law, and in which the European Court of Justice more and more assumes the final say; andthe European codification dimension, in which a potential instrument on the European level would compete with national laws and develop closely with them.
