Book excerpt: Par son aménagement et son fonctionnement, le régime dotal vise à équilibrer les rapports patrimoniaux qui existent dans les familles roussillonnaises. Celles-ci jouissent d'une très grande liberté dans l'organisation de leurs relations patrimoniales. Cette liberté se concrétise dans la rédaction d'actes complexes, les contrats de mariage ou conventions matrimoniales, conclus à l'occasion de mariages et qui visent à établir, d'une part, le régime matrimonial des nouveaux époux et, d'autre part, à régler la dévolution des biens de leurs parents. Ils constituent une véritable loi de la famille dont la conclusion repose sur trois principes : la liberté de contracter mariage, la liberté de disposer de ses biens et la liberté de transmettre l'héritage par actes entre vifs. La libre disposition des biens est guidée par la tradition et la conscience aiguë de l'intérêt de la maison, la casa, entité sociale, économique et politique qui regroupe autour de son chef, le cap de casa, la famille et le domaine, les personnes et les biens. L'intérêt de la maison est supérieur à celui de ceux qui la composent et en est nettement indépendant. Tout est donc fait pour éviter le morcellement du patrimoine. Le de cujus a donc le soin de choisir un héritier universel, l'hereu, s'il s'agit d'un garçon, la pubilla, s'il s'agit d'une fille, qui recueillera la part essentielle de la succession à travers l'hereditament. Le reste est partagé entre les autres enfants : il constitue la légitime qui leur sera remise, le plus souvent lors de leur mariage.

The importance of the human, economic and social issues caused by the question of generations’ solidarities led the International Society of Family Law to choose this theme for its XVIth World Congress (Lyon, July 19-23rd 2011). More than 200 speakers from 50 countries studied these questions from the legal angle, but also philosophic, economic and anthropological. This work collects a part of these papers about two great issues: the child, as the center of family solidarities; and the support for elders by family. Book excerpt: With marriage in decline, divorce on the rise, the demise of the nuclear family, and the increase in marriages and adoptions among same-sex partners, it is clear that the structures of kinship in the modern West are in a state of flux. In The Metamorphoses of Kinship, the world-renowned anthropologist Maurice Godelier contextualizes these developments, surveying the accumulated experience of humanity with regard to such phenomena as the organization of lines of descent, sexuality and sexual prohibitions. In parallel, Godelier studies the evolution of Western conjugal and familial traditions from their roots in the nineteenth century to the present. The conclusion he draws is that it is never the case that a man and a woman are sufficient on their own to raise a child, and nowhere are relations of kinship or the family the keystone of society. Godelier argues that the changes of the last thirty years do not herald the disappearance or death agony of kinship, but rather its remarkable metamorphosis—one that, ironically, is bringing us closer to the “traditional” societies studied by ethnologists.

Book excerpt: One of the world's most eminent social anthropologists draws upon his many years of study and research in the field of kinship and social organization to review the development of anthropological theory and method from Lewis Henry Morgan (1818-1881) to anthropologists of the 1960s. It is the central argument of this book that the structuralist theory and method developed by British and American anthropologists in the study of kinship and social organization is the direct descendant of Morgan's researches. The volume starts with a re-examination of Morgan's work. Professor Fortes demonstrates how a tradition of misinterpretation has disguised the true import of Morgan's discoveries. He follows with a detailed analysis of the work of Rivers and Radcliffe-Brown and the generation of anthropologists inspired by them. The author states his own point of view as it has developed in the framework of modern structuralist theory, with ethnographic examples examined in depth. He shows that the social relations and institutions conventionally grouped under the rubric of kinship and social organization belong simultaneously to two complementary domains of social structure, the familial and the political. Meyer Fortes' contribution to the field of anthropology can best be understood in the context of balance of forces between these domains of the personal and public. In the latter part of the book, he gives detailed attention to the principal conceptual issues that have confronted research and theory in the study of kinship and social organizations since Morgan's time. He shows that kinship institutions are autonomous, not mere by-products of economic requirements, and demonstrates the moral base of kinship in the rule of amity.
