Book excerpt: The year 2000's most significant international event was, almost certainly, neither political nor military, but scientific - the announcement, in June, that the human genome had been almost totally decoded. Future generations may well see this as a major turning point, opening the way to radical changes in diagnosis, prognosis, and medical treatment. Often compared with the space programme, this vast enterprise still generates misgivings: this new power, which human beings now have, to modify the genetic heritage of living creatures raises fundamentally new ethical questions - and society as a whole will have to find the answers. In fact, the accelerating pace of scientific and technical progress seems to be reviving atavistic anxieties, some rational, others less so. Recent public-health crises, including the mad cow disease' scare, which lasted into 2000, have fuelled these fears. The public's rejection of GMOs (Genetically Modified Organisms) - verging on a crusade in some countries - tells its own story. As regards conflict, 2000 saw the Middle East peace process grind to a halt, and the Intifada resume. In Europe, the situation in Kosovo and Chechnya, both the scenes of fighting in 1999, stayed precarious. Peace and democracy did score some successes, however, particularly in Europe: the centre-left's victory in Croatia, sweeping former President Tudjman's party off the scene, the democratic party's triumph in Bosnia, and the fall of the Milosevic regime in Serbia.

Book excerpt: The insertion in June 1997 of a Title on employment in the Treaty on European Union has accelerated the drafting of European policy in this field over the last few years. This European dynamic has had widespread impact on the themes and mechanisms that characterise national systems of industrial relations. On the one hand, employment is increasingly governed by rules negotiated between the social partners and, depending on the circumstances, the State. This phenomenon of joint labour market regulation is confirmed by a marked desire on the part of employers' associations and trade unions to integrate employment-related issues into their actions and negotiations. On the other hand, the incorporation of employment-related themes by employers’ associations and trade unions, usually in concertation with government policies, is related with greater coordination of bargaining and concertation mechanisms established at European level and within each Member State. Today, the various national realities appear to be directed to various degrees by these two general tendencies. These phenomena active in the field of employment bargaining must therefore be analysed on three counts: the first focuses on the development of the coordination mechanisms that structure these negotiations, and more specifically raises the issue of co-responsibility for the labour market; the second deals with the strict content of employment bargaining, and examines the question of negotiated flexibility of working conditions and employment; the third addresses the autonomy of collective bargaining in Europe. This analysis informs our research, which is in turn intimately linked to recent changes taking place in national systems of industrial relations.

The European Employment Strategy implemented in the European Union since 1997 invites social partners in all member states to participate in the promotion of employment at all levels. Is this the role of trade unions and employers organisations? Do social partners in the member states negotiate employment? Do they contribute to an objective of full employment? Do they want to improve 'employability'? Do they, finally, negotiate and reach agreements on such issues? Building on a in-depth study conducted by a European-scale network of experts for the DG Employment and Social Affairs of the European Commission, this report addresses these crucial issues. It analyses processes of collective bargaining and agreements on employment in the fifteen member states in 2000 and 2001. It includes national insights as well as comparative analyses of current trends. Researchers at the Institut des Sciences du Travail, a Department of the Catholic University of Louvain, here produce a fourth review of recent developments observed in the field of employment bargaining in Europe. This analysis, which has been conducted at the request of DG Employment and Social Affairs, focuses on agreements negotiated in the field of employment, and on the identification of the coordination mechanisms that structure these negotiations. The study contains 15 national contributions.

Available in PDF, EPUB and Kindle. Book excerpt: Europeanization has often been conceived as a top-down process, necessitating implementation and adjustment at the national level. However, Europeanization can also be conditioned by bottom-up national initiatives. While recent endeavors in comparative political economy have emphasized the resilience of coordinated market economies, few detailed empirical studies have examined to date exactly how different European systems of political-economic governance cope with and respond to an European impetus for liberalization. This original study of the impact of the EU-induced liberalization of service provision on member states argues that innovative national re-regulatory strategies may be implemented in response to Europeanization. In permitting any company registered in an EU member state to provide services throughout Europe, new possibilities were created for the transnational posting of workers from low-wage to high-wage countries. However, high-wage countries could re-regulate the wage levels applicable to such employees. The exact nature of such response strategy is coloured by the respective institutional power that labour market interest associations like trade unions and employer associations command. Therefore, different institutionalised varieties of capitalism generate distinct re-regulations of the Single European Market. Drawing on detailed case studies of ten European countries, this volume bridges the gap between the rapidly unfolding scholarly debate on Europeanization and varieties of capitalism. It argues that both strongly neocorporatist systems of political-economic governance and statist systems are capable of creating swift, comprehensive and thorough national re-regulations. This applies to Austria and France, but also Sweden, Denmark, Norway, Finland, Belgium, and Luxembourg. By contrast, countries with less strongly embedded neocorporatist structures, in which due to organizational deficiencies trade unions face difficulties blocking employer demands, create liberal response strategies, permitting a stratification of wage levels. Hence, both Germany and the Netherlands implemented liberal business-friendly re-regulations. The volume makes the case for important amendments to existing accounts of Europeanization and varieties of capitalism. Scholars of Europeanization need to incorporate bottom-up re-regulation into their conceptual framework, particularly in response to 'negative integration'. Recent strides in comparative political economy have placed great emphasis on continued divergence, yet this study suggests that even within the presumably unified group of 'non-liberal' coordinated market economies important institutional differences produce very distinct responses in the face of European liberalization.

They are often applied in varying degrees in various legal systems to a rather wide range of contract cases when certain issues arise issues such as abuse of rights, unfairness, good faith, fairness of duty or loyalty or honesty, duty of care, and other such contract terms not lending themselves readily to clear or permanent definition. Here for the first time is a systematic discussion of this kind of rule in the evolving and dynamic context of European contract law. A collection of twelve insightful essays by leading European law authorities, the book is based on a conference organized jointly by the Society of European Contract Law (SECOLA) and l'association Henri Capitant, held in the `grande salle' of the French Supreme Court in Paris in 2005. The subject is approached along three distinct but interconnected avenues: comparative contract law, in which the different models to be found among Member States particularly the Germanic, French, and English common law systems are explored with an eye to differences and common ground;EC contract law, in which the general clause approach has tended to focus on labour law and consumer law, and in which the European Court of Justice more and more assumes the final say; andthe European codification dimension, in which a potential instrument on the European level would compete with national laws and develop closely with them. The authors demonstrate that a focus on general clauses in contract law, embracing as it does a wide range of types of contracts, helps enormously with the necessary integration of legal scholarship and economic approaches, and of legal science and legal practice in the field. Numerous analytic references to relevant cases and EC Directives give a practical impetus to the far-reaching but immediately applicable theory presented in this important book. As European contract law continues to develop rapidly, this seminal contribution is sure to increase in value and usefulness.

The framework was developed by taking an analysis of employment and social protection in the Latin European countries as starting-point, and thus offers an innovative alternative to the dominant approaches. It takes account of the institutional forms determining employees' resource flows and associated rights, and introduces a new analytical category of «resource regimes». Four spheres are identified for the observation of recent resource regime changes: employment systems, public policy frameworks, social hierarchies and industrial relations systems. The various chapters explore how each of these spheres participates in the institution of social rights over resources, and identify key vehicles of change such as transformations in forms of employment, labour market policies, pension reforms, the swing to a logic of competencies, social pacts, and the processes involved in the construction of the European Union.
