Book excerpt: L'édifice de la paix et de la sécurité internationales repose sur le Conseil de sécurité des Nations unies et des organisations régionales, ses auxiliaires. Pourtant, si l'on reconnaît l'implication de ces dernières, il convient néanmoins de relever que leur relation avec l'organisation mondiale est très souvent disharmonieuse. C'est notamment le cas de la relation ONU/Union africaine dans leurs efforts de promotion et de protection de la paix et de la sécurité en Afrique. En effet, s'il est vrai que la subsidiarité est le principe qui encadre les rapports entre ces deux institutions, il n'en demeure pas moins que ceux-ci sont construits sur des antagonismes soulevant des préoccupations relatives à l'implémentation de ce principe. S'intéresser à la subsidiarité dans le maintien de la paix et de la sécurité en Afrique conduit, à cet effet, à analyser le cadre d'action du CSNU et du Conseil de paix et de sécurité de l'Union africaine. Cette vision passe aussi bien par la déclinaison de l'essence du principe de subsidiarité dans leurs interactions que par l'apport de la relation entre ces deux organisations dans l'ordre sécuritaire africain. Face au succès relatif de l'architecture internationale de paix et de sécurité, cette étude dévoile une relation entre ses acteurs pleine d'ambivalences, remettant en cause la centralité du Conseil de sécurité des Nations unies. Décryptant les échecs et les facteurs de réussite, les divergences de vues et d'objectifs entre l'ONU et l'UA dans la pacification du continent, l'auteur use d'un regard critique et lucide et ouvre de nouvelles pistes de réflexion pour de nécessaires réformes de l'arbitrage international.

It examines the institutions, norms, and processes for human rights realization provided for under the United Nations system, the African Union, and sub-regional economic communitites in Africa, and explores their relationship with the national legal systems of African states. Since the establishment of the African Union in 2001, there has been a proliferation of regional institutions that are relevant to human rights in Africa. These include the Pan African Parliament, the Peace and Security Council, the Economic, Social and Cultural Council and the African Peer Review Mechanism of the New Partnership for Africa's Development. This book discusses the links between these institutions. It further examines the case law stemming from Africa' most important human rights instrument, the African Charter on Human and Peoples Rights, which entered into force on 21 October 1986. This new edition contains a new chapter on the African Children's Rights Committee as well as full coverage of new developments and instruments, such as the Convention on the Rights of Persons with Disabilities, the Convention on Enforced Disappearances, and the African Charter on Democracy, Elections and Governance.
