La grille utilisée distinque les notions d'efficacité, et d'effectivité, l'evaluation de l'efficience n'entrant pas dans le champ de nos investigations. L'essentiel de la recherche porte sur la notion d'efficacité de l'expropriation dans le processus de libération des immeubles au profit de la puissance publique. La mesure de l'efficacité s'appuie sur l'observation des appareils dans leur double dimension : compétence et procédure. De même, l'effectivité comprise comme un rapport de conformité entre un système de valeurs établies et la pratique, renvoie au code de l'institution, lui même décompose en deux branches : l'utilité publique et le principe d'indemnisation. La mesure de l'effectivité est indissociable de la question de la légitimité laquelle conditionne l'adhésion et le consensus.
