Dans notre société actuelle on se croit invincible, protégé par un effet d'irréalité. L'absence de lien social créé par l'isolement et l'anonymat déconnecte de la notion de communauté et de partage. De ce fait la mort, aujourd'hui, se doit d'être propre, discrète, dénuée de toute émotion ; il n'y a plus aucun signe extérieur de deuil. Notre culture a eu des rituels de mort qui aujourd'hui ont presque tous disparu alors qu'ils sont reconnus indispensables au processus de deuil. La création des milieux de soins palliatifs semble pouvoir répondre à ce besoin de ritualisation de la fin de vie, de la mort, du deuil et du suivi de deuil. Ils offrent la possibilité pour les proches de réaliser un accompagnement de qualité. Les familles, écoutées, entendues, soutenues par les équipes soignantes, sont mieux préparées à la séparation prochaine, ce qui les aide à rester présentes auprès de leur parent malade. Tout cela peut permettre aux familles, malgré la douleur de la perte, de ressentir après coup, le sentiment d'avoir pu accomplir le dernier chemin avec le disparu et d'éviter ainsi un deuil compliqué ou pathologique. Le congé d'accompagnement rémunéré récemment mis en place permettra d'obtenir, pour les proches, ce temps nécessaire à la réalisation d'un accompagnement de qualité.

Book excerpt: Object of fascination and fantasy, the female body can be idealized, reified or shrouded. “It is we who make women what they are worth and that is why they are worthless”, proclaimed Mirabeau in the days of the Enlightenment, to which Aragon later replied: “Woman is the future of Man”. The ambiguities of the female body are therein exposed. This work examines the relationship between the female body and biomedicine. Many possibilities are offered to women through biomedical techniques: from assistance to procreate (with assisted reproduction) to refusal to do so (contraception, voluntary sterilization, termination of pregnancy); to be informed of genetic predispositions (through the use of available genetic tests); or to improve their physical appearance with cosmetic surgery. But a recurrent question arises: with its rapid progress and its extreme medicalization of the body, can biomedicine liberate women? Or rather, given the risks of the commodification of the body or its parts, is it not a source of exploitation ? The authors of this work, jurists, anthropologists, philosophers, sociologists and doctors, have explored these questions. The contributions from nineteen countries in this international multidisciplinary study analyse the reality of the amazing developments of biomedicine on the female body. Numerous systems are compared for the first time; European, African, North and South American, but also Chinese and Japanese. Beyond highlighting differences, and identifying similarities in the development of “enhancement medicine”, the objective of this work is ultimately to show the complexity surrounding the question of a woman’s freedom over her body and the extent to which this is limited by the State.

The importance of the human, economic and social issues caused by the question of generations’ solidarities led the International Society of Family Law to choose this theme for its XVIth World Congress (Lyon, July 19-23rd 2011). More than 200 speakers from 50 countries studied these questions from the legal angle, but also philosophic, economic and anthropological. This work collects a part of these papers about two great issues: the child, as the center of family solidarities; and the support for elders by family. Phenomena such as increasing life expectancy, population urbanization, labor-market entry barriers, decline of traditional family patterns, mark in depth our contemporary world and involve old solidarity disappearance and new solidarity emergence, reshaping relations between generations while bringing up the problem of the fate of the most vulnerable: children, the sick, disabled, and especially elderly people. – What then is the role of families and communities in protecting these people? – What is the relationship between public and private solidarity? – What are the rights and freedoms of people placed by age, illness or disability in a dependence situation? Section II provides detailed commentaries on recent international instruments relating to biomedicine adopted by UNESCO and the Council of Europe. Section III elaborates upon specific biomedical human rights issues that are the subject of contemporary international standard-setting efforts, including biomedical research, population biobanks, genetic testing, and advance directives.
