Book excerpt: Cette étude consiste à démontrer que les procédures administratives d'urgence ont entraîné une modification de la conception du rôle du juge administratif : d'une part, par rapport aux libertés fondamentales dont le juge administratif a dû déterminer et encadrer la notion ; d'autre part, par rapport à l'autorité administrative vis-à-vis de laquelle le juge administratif a retiré un pouvoir accru qui lui donne la vigueur d'un juge administrateur. Cette étude est présenté en deux parties on s'attacher, dans une première partie, à montrer comment les procédures d'urgence, mises à sa disposition par la loi du 30 juin 2000, permettent au juge administratif de faire cesser les atteintes aux libertés fondamentales. Dans une deuxième partie, on tentera de mettre en lumière l'évolution du rôle du juge administratif dans ses relations avec l'administration. Les procédures d'urgence ont conduit à l'élargissement de ses pouvoirs, ce qui a entraîné un renforcement de l'autorité du juge administratif par rapport l'administration.

Le texte et ses arrêtés d’exécution apportent non seulement de profondes modifications à la procédure en suspension mais introduisent également d’importantes nouveautés comme la boucle administrative ou l’indemnité réparatrice. Très controversée, critiquée car trop politique ou trop éloignée des réalités quotidiennes de la juridiction, attaquée devant la Cour constitutionnelle et le Conseil d’État lui-même, la réforme est secouée de toutes parts et il semble encore difficile de déterminer si les changements qu’elle apporte seront autant de tentatives manquées de moderniser la procédure ou, au contraire, d’utiles innovations améliorant l’accès au Conseil d’État et la réception de ses arrêts par les autorités administratives. Dans ce contexte, le présent ouvrage qui reprend les exposés présentés lors des colloques des 21 et 28 mai 2015 organisés par la Conférence du jeune barreau de Bruxelles sous la présidence de Patrick Goffaux et de David Renders, se donne pour objectif de dresser un état des lieux pratique de la procédure contentieuse administrative un an après la réforme du Conseil d’État. Une part importante des travaux sera consacrée au Conseil d’État lui-même, en offrant un aperçu général de la procédure telle qu’aujourd’hui en vigueur mais également en abordant, d’un point de vue sectoriel, les apports de la réforme dans le contentieux de la fonction publique, le contentieux des marchés publics et le contentieux de l’urbanisme et de l’environnement. Différentes interventions donneront, par ailleurs, l’occasion de faire le point sur les « nouveaux lieux de justice administrative » – nouvelles juridictions ou tribunaux judiciaires – vers lesquels le législateur tend à transférer certaines compétences « classiques » du Conseil d’État et dont le rôle grandissant n’est pas sans poser question.

They deliberately made use of stylistic elements or refrained from using certain features in order to reach their target audience. There are certain groups of texts dating from various periods on which these stylistic elements can be tracked precisely by comparison of two or even more versions with their model text. Such examples of rewriting can be found particularly within genres with a broader audience appeal, namely hagiography and historiography. It is in both genres that we encounter metaphrastic processes, in terms of stylistic elaboration and in terms of stylistic simplification.0As well as stylistic reshaping, metaphrasis may also encompass the addition or removal of literary and/or thematic aspects. All these processes signify intent as well as authorial interpretation. Frequently, the ideological orientation of a text is refurbished through rewriting. Teasing out these strands for exploration helps to supply a potential wealth of information on the author (if known), cultural (social, religious, historical) context, and creative ability, as well as levels of education and literacy.

Like the other series, these chronicles provide a survey of significant trends in contemporary philosophical discussion from 1970 to 1985. The need for such surveys has, I believe, increased rather than decreased over the last years. The philosophical scene appears, for various reasons, more complex than ever before. The continuing process of specialization in most branches, the emergence of new schools of thought, the convergence of interest (thought not neces sarily of opinion) of different traditions upon certain problems, the increasing attention being paid to the history of philosophy in discussions of contemporary problems, and the growing signifi cance for philosophical discourse of the social, political and cul tural situation in various regions of the world are the most impor tant contributory factors. Surveys of the present kind are a valu able source of knowledge of this complexity and may as such be an assistance in renewing the understanding of one's own philo sophical problems. The surveys, it is to be hoped, may also help to strengthen a world-wide Socratic element of modern philosophy, the dialogue or Kommunikationsgemeinschaft. So far, five volumes have been prepared for the new series.
