However, at the same time, the flow of people and the growth of trade have continued at impressive rates, and arguments for more open borders remain relevant. In The Border, Martin Schain compares how and why border policy has become increasingly important, politicized, and divisive in both Europe and the United States. Drawing from an intensive analysis of documents and interviews, he argues that border control is a growing international movement. In Europe, the European Union is under scrutiny, and many countries seek to block the entry of asylum-seekers from wars in the Near East. In the US, Donald Trump pledged to build a wall along the Mexico border, restricted the entry of Syrian asylum-seekers, and more generally tried to ban Muslim immigration. The Europeanisation of immigration policy has provoked the emergence of distinctive European approaches on integration. The legal elements of integration are being developed through two parallel settings: the EU Framework on Integration and European immigration law. These venues constitute two of the main pillars upon which the common EU immigration policy is being constructed, and their nexus raises several elements in need of reflection and study. This book examines the processes through which integration becomes a norm in nationality and immigration law and policy at the national and EU levels, and the implications of these processes for the legal status of third country nationals and the overall coherency of the common EU immigration policy.

Book excerpt: In recent years states across the world have boosted their legal and institutional capacity to deport noncitizens residing on their territory, including failed asylum seekers, “illegal” migrants, and convicted criminals. Scholars have analyzed this development primarily through the lens of immigration control. Deportation has been viewed as one amongst a range of measures designed to control entrance, distinguished primarily by the fact that it is exercised inside the territory of the state. But deportation also has broader social and political effects. It provides a powerful way through which the state reminds noncitizens that their presence in the polity is contingent upon acceptable behavior. Furthermore, in liberal democratic states immunity from deportation is one of the key privileges that citizens enjoy that distinguishes them from permanent residents. This book examines the historical, institutional and social dimensions of the relationship between deportation and citizenship in liberal democracies. Contributions also include analysis of the formal and informal functions of administrative immigration detention, and the role of the European Parliament in the area of irregular immigration and borders. The book also develops an analytical framework that identifies and critically appraises grassroots and sub national responses to migration policy in liberal democratic societies, and considers how groups form after deportation and the employment of citizenship in this particular context, making it of interest to scholars and international policy makers alike. “It is commonly surmised that the increased flows of goods, ideas, finance and people are slowly leading to the dissolution of boundaries between nation-states. By taking the example of Indian skilled migration, this study identifies ways of involving returned skilled migrants in home country development as well as proposes approaches to engage the diaspora in development. As high-skill immigration from India to mainland Europe is a rather recent phenomenon, the activities of Indian professionals in Europe are under-researched. The findings have wider application in contributing to the policy dialogue on migration and development, specifically to the advantage for developing and emerging economies. The book employs an interdisciplinary, two-fold approach: The first part of the research looks at how international exposure affects the current situation of skilled returnees in India. The second, European, part of the research examines migration policies, labour market regulations and other institutional settings that enable or hinder skilled Indians’ links with the country of origin. Structural differences between the host countries may facilitate different levels of learning opportunities; thus, this book identifies good practices to promote the involvement of Indian skilled diaspora in socio-economic development. In applying the framework of diaspora contributions as well as the return channel to study the impact on India, the book draws on qualitative and quantitative research methods consisting of policy analysis, in-depth interviews with key experts and skilled migrants and on data sets collected specifically for this study.
