Download or read book Good Administration and the Council of Europe written by Ulrich Stelkens and published by Oxford University Press. This book was released on 2020-09-11 with total page 912 pages. Available in PDF, EPUB and Kindle. Book excerpt: Good Administration and the Council of Europe: Law, Principles, and Effectiveness examines the existence and effectiveness of written and unwritten standards of good administration developed within the framework of the Council of Europe (CoE) and in the case law of the European Court of Human Rights. These standards - called 'pan- European general principles of good administration' - cover the entire range of general organizational, procedural, and substantive legal institutions meant to ensure a democratically legitimized, open, and transparent administration respecting the rule of law. They are about the 'limiting function' of administrative law: its function to protect individuals from arbitrary power, to legitimize administrative action, and to combat corruption. This book analyses the sources and functions of the pan-European general principles of good administration and seeks to uncover how deeply they are rooted in the domestic legal systems of the CoE Member States. It comprises 28 country reports dedicated to an in-depth exploration of the impact of these standards on the national legal systems of the Member States written by respective experts on these systems. It argues that the pan-European general principles of good administration lead to a certain harmonization of the legal orders of the Member States with regard to the limiting function of administrative law despite the many fundamental differences between their administrative and legal systems. It comes to the further conclusion that the pan-European general principles of good administration can be considered as a concretization of the founding values of the CoE and describes the 'administrative law obligations' a Member State entered into when joining the CoE.

Download or read book The right to free elections written by Yannick Lécuyer and published by Council of Europe. This book was released on 2014-12-01 with total page 138 pages. Available in PDF, EPUB and Kindle. Book excerpt: The right to free elections is one of the most difficult rights to define: while it is an objective and essential principle in any democratic society, it is also a fundamental personal right on which every citizen can rely. It is an individual right, but it is meaningful only as part of a collective process. That same right, in conjunction with the right to vote and the right to stand for election, needs to be practised in a democratic way which also brings into play many other rights and freedoms, before, during and after the election itself. It is also one of the most highly valued rights at the Council of Europe because it helps to promote the “true democracy” which underpins the Organisation, alongside the rule of law and the honouring of fundamental freedoms. This book examines the main Council of Europe legal texts and sources on this topic: conventions, resolutions, recommendations and guidelines, without forgetting the abundant case law of the European Court of Human Rights. It is a work for legal practitioners, students and, more generally, anyone interested in how Europe and democracy go hand in hand.

Download or read book The Right to Life in European Constitutional and International Case law written by Bertrand Mathieu and published by Council of Europe. This book was released on 2006-01-01 with total page 128 pages. Available in PDF, EPUB and Kindle. Book excerpt: The right to life is the prime individual right in treaty and constitution systems of fundamental rights. The whole approach to protecting this right has changed considerably with scientific and medical advances. Whereas traditionally the concern was to protect life from all threats, today there is the additional very prominent issue of human, scientific and medical intervention in the life-giving process in such forms as abortion, medically assisted procreation, embryo research, cloning and euthanasia. This comparative analysis of the case law of Europes constitutional courts and the Council of Europes European Court of Human Rights examines the nature and scope of the right to life in order to determine whether there is a common legal approach to the question in Europe

Download or read book Diversity of Methodological Approaches in Social Sciences written by Inna Lyubareva and published by John Wiley & Sons. This book was released on 2023-09-01 with total page 228 pages. Available in PDF, EPUB and Kindle. Book excerpt: As with many rapidly evolving areas, research on pluralism in media and information makes use of appropriate interdisciplinary approaches that consider diverse and interdependent factors. These considerations include new economic constraints, journalistic production, networked technologies, online social interactions, new forms of discourse, consumer preferences and practices, and the specificities of information markets. This book presents and assesses several methodological approaches that have proven to be valuable in the study of transformations in media and information. Some are well-known in social sciences (e.g. qualitative analysis by interviews), whereas others come from different disciplines and remain rare and original (e.g. agent-based modeling). By focusing on various dimensions of the media and information pluralism, this book pulls together methods based on network analysis, agent-based modeling and sociosemiotics, as well as qualitative and legal approaches. Each of the five chapters introduces a specific method and its relevance for the analysis of a particular research question.

Download or read book La famille dans l ordre juridique de l Union europ enne Family within the Legal Order of the European Union written by Elsa Bernard and published by Bruylant. This book was released on 2020-12-31 with total page 409 pages. Available in PDF, EPUB and Kindle. Family law, with its civil law tradition, and strong roots in the national cultures of the Member States, does not normally fall within the scope of European law. However, it is no longer possible to argue that family law is outside European law entirely. There are many aspects of the family which are subject to European influence, to the point that the outlines of a «European family» are starting to emerge. This book is intended to highlight the European experience of family law and its substantive (i.e. European citizenship, EU social policy, EU civil service...) and private international law aspects. Union law therefore contains a form of «special» family law which is shared between the Member States and supplements their national family laws. Its theoretical and political importance in the Union, as well as its future, are discussed by the authors. Far from remaining fragmented alongside the national laws of Member States, it will likely develop to offer European citizens and residents a common family law within the EU.

Book excerpt: The Department of Public Prosecution and Judicial Police in Cameroon, while tracing the historical background of the Legal Department, carefully walks you through its institutional framework and governing principles, while highlighting its omnipresence at all phases of the procedure (police investigation, preliminary inquiry, hearing before the Courts as well as in the execution of Court Judgments). The said ubiquitous presence is accentuated by the lawmakers who in some instances render it not only necessary but mandatory as well. Curiously, the Department of Public Prosecution is presented as that principal party who is not responsible for malicious prosecution. Chief Justice Bechem Eyong Eneke President Court of Appeal, Buea, South West Region &&&&& This book is incontrovertibly a major contribution towards the development of Cameroons legal system. It presents the Public Prosecution Department (Legal Department), incarnated by the Public Prosecutor (State Counsel), as one of the rare omnipresent actors in criminal proceedings whose presence in all phases of the criminal procedure is almost mandatory, while her role is primordial. It presents a cogent, critical, and lucid analysis of the multi-dimensional institution embodied by the State Counsel from a historical perspective and within the context of the CPC. In a clear and simple style, the book provides practical solutions to diverse theoretical and practical issues faced by legal practitioners in the application of the CPC pertaining to the institution the Legal Department. The discussion is incisive, meticulous, and buttressed with statutory provisions and available cases. Bih Che épouse Anye Nde Abegley State Counsel, Court of First Instance Bali, North West Region

This book was released on 2016-02-10 with total page 367 pages. Available in PDF, EPUB and Kindle. Download or read book The Right to Life written by Christian Tomuschat and published by BRILL. This book was released on 2010-03-08 with total page 432 pages. Available in PDF, EPUB and Kindle. Book excerpt: The right to life stands at the heart of human rights protection. Individuals cannot enjoy any of the rights guaranteed to them unless their physical existence is ensured. All human rights instrument list the right to life as the first one of their safeguards. Nonetheless, in many situations human life finds itself under structural threat. Although obligated by law to protect the right to life, State authorities time and again engage in deliberate acts of killing. Fortunately, international review bodies have devised many imaginative counter-strategies. Another one of those structural threats is global warming. Obviously, armed conflict puts human life inevitably at risk; the limits of the ‘license to kill’ given by the laws of war must be scrupulously observed.
