Book excerpt: Il existe deux familles théoriques principales qui abordent la question des fondements des droits de l'homme : les approches naturalistes et les approches politiques. L'objectif de ce mémoire est d'analyser les limites de ces deux types d'approches et de proposer une manière de les dépasser tout en conciliant leurs avantages respectifs, ce qui sera fait au sein d'une conception délibérative de ces droits. Les approches naturalistes montrent qu'il est important de dégager un fondement indépendant pour garantir le potentiel critique des droits de l'homme. Cependant, elles peinent à développer une réflexion satisfaisante par rapport à leur réalisation institutionnelle; une réflexion politique complémentaire est nécessaire pour identifier les devoirs et les responsabilités associées au régime des droits de l'homme. Or, bien que les approches politiques considèrent directement ces questions institutionnelles, elles font ressortir une difficulté particulière quant au fondement normatif des droits humains. Il est nécessaire de concilier l'affirmation d'un fondement indépendant pour garantir leur dimension critique avec la mise en place d'une discussion politique réelle concernant leur contenu. Cette conciliation est possible au travers d'une conception délibérative si on considère la délibération comme une théorie de second ordre à l'instar d'Amy Gutmann et de Dennis Thompson. Cela implique que les droits humains reposent sur une reconnaissance réciproque de l'égalité morale de chaque personne. Cette reconnaissance réciproque a des implications institutionnelles autant au niveau national qu'au niveau transnational. Bref, il s'agit ici de voir comment l'identification de normes morales indépendantes et des conditions institutionnelles d'inclusion délibératives peuvent interagir au sein d'un régime des droits de l'homme pour protéger la dignité égale de chaque être humain.

It was in that city in the sixteenth century that, prompted by his Dominican brothers, such as Bartolome de las Casas, who were defending the indigenous people of Latin America against the Spanish conquistadores, Francisco de Vitoria planted the seed of today's international human rights movement. This volume presents in original languages the eleven papers given in Salamanca as well as the statement adopted by the delegates at the end of the meeting. They combine historical views, theoretical insights and testimonies from life experience. This was undertaken under the auspices of the African Union (previously OAU), and the revision was adopted by its Heads of State and Government in July 2003 in Maputo. The introduction provides an overview of this new international treaty, as well as a commentary to each of its provisions.
