Héritage du droit romain, mais complètement marginalisée dans un code civil voué à la primauté des liens du sang, l'adoption connaît un surprenant retour de fortune depuis la seconde moitié du XXème siècle. Elle le doit à une conception plus affective et volontaire des rapports de parenté dans les bouleversements familiaux contemporains. Mais une contradiction s'instaure - qui fait l'objet des deux premières parties - entre le poids croissant de l'administration et de la justice donnant un caractère constitutif à l'adoption et l'attachement à l'aspect contractuel originaire. La troisième partie, qui intègre l'étude de la Convention de La Haye et de la réforme du droit international français par la loi du 6 février 2001, s'attache aux difficultés propres aux conflits de lois et de juridictions, avec la recherche d'un équilibre entre droits des Etats des adoptants et ceux des adoptés.
