Book excerpt: Just how International and European Community Law is being integrated into domestic legal systems is as yet not too well known. To gain a clear overview of this grey area requires more than knowing about the various constitutional rules. What is also needed is a study of little-known administrative practices and the attitudes of the national courts, where case-law is often as complex as it is diverse. When all these elements are taken into account, the general picture that emerges is a much more subtle one, transcending the classical positions based on the theories of monism and dualism. To grasp this reality and go beyond preconceived ideas, it seemed indispensable to make a thorough analysis of national practices. To this end, the International Law Centre of the University of Paris XIII (Cedin Paris XIII) took the initiative, in 1990, of setting up a network of European international lawyers to work on the theme International norms and legal barriers'. This book presents the outcome of the network's programme. The research was organized on the basis of a single questionnaire which provided the outline of a common workplan, to which each of the contributors has adhered. Detailed comparisons of national practices can now be made, relating in particular to international treaties, acts of international organisations and of the European Communities, and to unwritten international law. This is the first time that such a comprehensive and detailed survey has been made of all thirteen countries. Reading the national reports one after the other provides complete information on domestic practices; reading them crosswise gives a direct comparison between the different countries on specificissues.

Traditionally, trade agreements in the Americas were concerned with economic questions and paid little attention to human rights. However, in the wake of the 'new regionalism', which emerged at the end of the last century, more clauses addressing social issues such as labour rights and environmental standards were inserted in trade agreements. As economic integration increased, a framework for the protection of human rights evolved. This book argues that this framework allows for human rights protection on a transnational level, while constructing regional identities. Looking at the four key regional integration processes, namely the Caribbean Community, the Central American Integration System, the Andean Community of Nations and the Southern Common Market, and also at the North American Free Trade Agreement, it shows how the integration process has reached a considerable degree of consolidation. Writing on key sources in English for the first time, this book will be essential reading for all free trade and human rights scholars.

While so-called migration crises in North Africa in 2005 and 2011 made the instability of the increasingly militarized border regime visible, they also created space for new actors and instruments to emerge under the label of international migration management, promising softer forms to control migration outside Europe. Who are these actors, and how do they think and practice migration control without the use of physical force and obvious repression? This book develops an innovative theoretical framework that mobilizes Bourdieu’s Theory of Practice to critically investigate the work of the IOM in Morocco and Tunisia between 2005 and 2015. Analyzing its information campaigns, voluntary return programs, and anti-trafficking politics, the book shows how this organization teaches (potential) migrants and North African actors to understand migration as their own problem and its management as their own responsibility. This book advances our understanding of the complex and ambivalent practices of controlling migration through information, protection and repatriation, and the implications of ubiquitous but underresearched institutions, such as the IOM, in this contested field. Book excerpt: The Treaty of Rome makes no mention of the Mediterranean basin as such, inc1udes not a single provision for the defining of specific relations with that region as a whole. There are only, as a hang-over from the French and Italian colonialist past, certain Dec1arations, in the Appendices, regard ing a possible association of Tunis, Morocco, Libya with the new under taking. And, of course, there is Artic1e 113 prescribing, at the end of the Community's transition period, the common trade policy - plus the Artic1e (238) giving blanket authorisation for association agreements. These legal prescriptions were duly implemented in the Association Agreements with Greece (1961) and Turkey (1963) and have supplied the basis for bilateral instruments in respect of other Mediterranean lands - ad hoc, pragmatic ar rangements. In the circumstances the Community could scarcely have proceeded otherwise. Yet the outlines of a European economic policy with regard to the countries of the Mediterranean basin were there from the beginning -limited, however, over the years by the internal development of the Community itself. One is reminded in this connection of sundry invoca tions by European and Mediterranean personalities and members of the European Commission - and, specifically, of a Memorandum presented by Italy to the Council of Ministers in 1964.
