Book excerpt: By highlighting the connections between domestic political struggles and overseas imperial structures, The Politics of Imperial Memory in France, 1850–1900 explains how and why French Republicans embraced colonial conquest as a central part of their political platform. Christina B. Carroll explores the meaning and value of empire in late-nineteenth-century France, arguing that ongoing disputes about the French state's political organization intersected with racialized beliefs about European superiority over colonial others in French imperial thought. For much of this period, French writers and politicians did not always differentiate between continental and colonial empire. By employing a range of sources—from newspapers and pamphlets to textbooks and novels—Carroll demonstrates that the memory of older continental imperial models shaped French understandings of, and justifications for, their new colonial empire. She shows that the slow identification of the two types of empire emerged due to a politicized campaign led by colonial advocates who sought to defend overseas expansion against their opponents. This new model of colonial empire was shaped by a complicated set of influences, including political conflict, the legacy of both Napoleons, international competition, racial science, and French experiences in the colonies. The Politics of Imperial Memory in France, 1850–1900 skillfully weaves together knowledge from its wide-ranging source base to articulate how the meaning and history of empire became deeply intertwined with the meaning and history of the French nation.

Book excerpt: For most of the seventeenth and eighteenth centuries, classical dogma and royal censorship worked together to prevent French plays from commenting on, or even worse, reenacting current political and judicial affairs. Criminal trials, meanwhile, were designed to be as untheatrical as possible, excluding from the courtroom live debates, trained orators, and spectators. According to Yann Robert, circumstances changed between 1750 and 1800 as parallel evolutions in theater and justice brought them closer together, causing lasting transformations in both. Robert contends that the gradual merging of theatrical and legal modes in eighteenth-century France has been largely overlooked because it challenges two widely accepted narratives: first, that French theater drifted toward entertainment and illusionism during this period and, second, that the French justice system abandoned any performative foundation it previously had in favor of a textual one. In Dramatic Justice, he demonstrates that the inverse of each was true. Robert traces the rise of a "judicial theater" in which plays denounced criminals by name, even forcing them, in some cases, to perform their transgressions anew before a jeering public. Likewise, he shows how legal reformers intentionally modeled trial proceedings on dramatic representations and went so far as to recommend that judges mimic the sentimental judgment of spectators and that lawyers seek private lessons from actors. This conflation of theatrical and legal performances provoked debates and anxieties in the eighteenth century that, according to Robert, continue to resonate with present concerns over lawsuit culture and judicial entertainment. Dramatic Justice offers an alternate history of French theater and judicial practice, one that advances new explanations for several pivotal moments in the French Revolution, including the trial of Louis XVI and the Terror, by showing the extent to which they were shaped by the period's conflicted relationship to theatrical justice.

Jens Meierhenrich provides a redescription of Rwanda's daring experiment in transitional justice known as inkiko gacaca. By dissecting the temporally and structurally embedded mechanisms and processes by which change agents in post-genocide Rwanda manoeuvred to create modified legal arrangements of things past, Meierhenrich reveals an unexpected jurisprudence of violence. Combining nomothetic and ideographic reasoning, he shows that the deformation of the gacaca courts – and thus the rise of lawfare in post-genocide Rwanda – was not preordained but the outcome of a violently structured contingency. In contrast to Jews in many parts of German-occupied Europe, however, the majority of Jews in France survived, thanks to opposition to the Nazi extermination policy from Church dignitaries and the moral indignation of the average Frenchmen. Seeking to maintain popular support, the Vichy Regime bargained with the Germans over the substance and extent of its collaboration, which the Germans needed in order to hold France. Drawing on German and French sources, Wolfgang Seibel traces the twisted process of political decision-making that shaped the fate of the Jews in German-occupied France during World War II. By analyzing the German-French negotiations, he reveals the underlying logic as well as the actual course of the bargaining process as both the Vichy Regime and the Germans sought a stable relationship. Yet that relationship was continually reshaped by the progress of the war, Germany’s deteriorating prospects, France’s economic and geopolitical position, and the Vichy government’s quest for domestic political support. The Jews’ suffering intensified when the Germans had the upper hand; but when the French felt empowered, the Vichy Regime stopped collaborating in the completion of the “final solution.” Persecution and Rescue: The Politics of the “Final Solution” in France, 1940–1944 demonstrates the ways in which political circumstances can mitigate—or foster—mass crime.
