Book excerpt: This book traces the evolution of environmental principles from their origins as vague political slogans reflecting fears about environmental hazards to their embodiment in enforceable laws. Since the early 1970s environmental issues have taken on an ever increasing profile. This has been duein part to a fundamental change in the type and scale of risk posed by industry. Issues such as global warming, GM food, and mad cow disease typify the new kinds of risk: potentially catastrophic consequences could ensue yet there is no scientific agreement over their precise causation, duration andother concerns. Environmental law has always responded to risks posed by industrial society but the new generation of risks have required a new set of environmental principles, emerging from a combination of public fears, science, ethics and established legal practice. This book shows how three ofthe most important principles of modern environmental law grew out of this new age of ecological risk: the polluter pays principle, the preventive principle and the precautionary principle. The author examines the legal force of these principles and in the process offers a novel theory of normformation in environmental law by unearthing new grounds of legality.The book will be of interest to all with an interest in environmental law and policy, in the relationship between law and science, and in the ways in which political and ethical values can become embodied in laws.

Book excerpt: This volume comprises three parts: 1) from local to global, 2) what type of sustainable management? 3) territorial approaches. The first chapter demonstrates, from the French example, that better soil management is a societal issue. At the global level, the second chapter raises the question of land grabbing and land use conflicts. This book also raises the question of the legal status of the soil. It then shows how soils need to be integrated when defining sustainable agricultural systems. French and European examples illustrate how taking environmental problems into account depends as much on their acuity as on how problems are perceived by public and private, social or economic actors. Therefore, it is important to promote co-diagnosis involving the scientific community and the various other actors in order to improve the regulation on soils. This multi-actor soil governance is facilitated by the use of simple soil quality indicators. Finally, examples in France and Vietnam show how soils are to be considered as territorial commons within landscapes. This last chapter recommends in particular to put an end to the absolute right of soil ownership and to distribute the usufruct of land between various private and public beneficiaries.

The Biodiversity Convention and the Nagoya Protocol only address the genetic resources of national areas. Patents allow their holder to exercise a monopoly on exploiting biotechnological creations to extensive claims, questioning the common nature of biodiversity and related knowledge. They hinder research and the objectives of biodiversity law. The legal and practical rules of physical and functional access vary in geometry. They focus on the valorization of research results, crystallizing conflicts of interest between suppliers and users. Sustainable research and development is essential to the knowledge and protection of marine biodiversity. The qualification of marine genetic resources in common, standard contractual tools, distributed research and development infrastructures, negotiation of an agreement on sustainable use and conservation of biodiversity beyond the limits of national jurisdiction, would To remove these inconsistencies.

Corps de règles complexe, technique, faisant appel à des concepts scientifiques ardus à interpréter pour un non-scientifique, le régime Natura 2000 n’est guère aisé à appliquer pour un juge non spécialisé. Le recours à l’expertise est souvent indispensable pour déterminer dans quelle mesure tel ou tel standard – par exemple le caractère « significatif » d’un impact – a été respecté ou non. Pour cette raison, les solutions trouvées par le juge aux différents problèmes que pose l’application du régime Natura 2000 dans les différents États membres méritent l’attention et sera enrichissante tant pour le chercheur que pour le praticien. As part of the activities of the Legal Observatory Natura 2000, this book focuses on legal issues arising from the implementation by the national courts – constitutional, administrative and judicial ones – of the provisions relating to Natura 2000, in order to assess the contribution of the judge to the effectiveness of this regime. The enforcement of this legislation, which encompasses a complex body of technical rules, grounded on scientific concepts difficult to interpret for a non-scientist, is not easy to apply by a non-specialized judge. The use of expertise is essential to determine how a particular standard – for example the «significant» character of an impact – has been met or not. For this reason, the solutions found by the judge to the various problems arising from the application of the Natura 2000 provisions in the different Member States deserve attention and will be rewarding for both researchers and practitioners.
