Available in PDF, EPUB and Kindle. Book excerpt: Daniel Webster captured the hearts and imagination of the American people of the first half of the nineteenth century. This bibliography on Webster brings together for the first time a comprehensive guide to the vast amount of literature written by and about this extraordinary man who dwarfed most of his contemporaries. This bibliography also provides references to materials on slavery, the tariff, banking, Indian affairs, legal and constitutional development, international affairs, western expansion, and economic and political developments in general. This bibliography is divided into fifteen sections and covers every aspect of Webster's distinguished career. Sections I and II deal primarily with Webster's writings and with those of his contemporaries. Sections III through X cover the literature dealing with his family background; childhood and education, his long service in the United States House of Representatives and in the Senate, his two stints as secretary of state, and his career in law. Section X provides guidance in locating materials relating to his associates. Finally, Sections XI through XV provide coverage of his personal life, his death, historiographical materials, and iconography.

Book Reading Law Forward

    Book Details:
  • Author : Peter Charles Hoffer
  • Publisher : University Press of Kansas
  • Release : 2023-07-14
  • ISBN : 0700635084
  • Pages : 246 pages

Download or read book Reading Law Forward written by Peter Charles Hoffer and published by University Press of Kansas. This book was released on 2023-07-14 with total page 246 pages. Available in PDF, EPUB and Kindle. Book excerpt: In the current legal climate where “everyone is an originalist,” conventional wisdom suggests that judges merely find law, rather than make it. Orthodox common-law jurisprudence makes fidelity to the past the central goal and criterion. By contrast, the alternative approach, “reading the law forward”—what some call judicial pragmatism or consequentialism—is viewed as heretical. Rather than mount a theoretical defense of a forward-thinking jurisprudence, legal historian Peter Charles Hoffer offers an empirical study of how this approach to constitutional interpretation actually leads to better law. Reading Law Forward looks at seven judges who exemplify this alternative jurisprudence: John Marshall, Joseph Story, Lemuel Shaw, Louis D. Brandeis, Benjamin Cardozo, William O. Douglas, and Stephen G. Breyer. “In the hands of America’s leading judges, a jurisprudence of reading law forward enabled courts to respond to the challenges of changing conditions. It kept law fresh. It promoted and still promotes the growth of a democratic society,” Hoffer convincingly argues.

Book The Letters of William Cullen Bryant

Download or read book The Letters of William Cullen Bryant written by William Cullen Bryant and published by Fordham University Press. This book was released on 2019-11-05 with total page 525 pages. Available in PDF, EPUB and Kindle. Book excerpt: The years just before and during the Civil War marked the high point of Bryant's influence on public affairs, which had grown steadily since the Evening Post had upheld the democratic Jacksonian revolution of the 1830s. A founder of the Free Soil Party in 1848 and the Republican Party in 1856, Bryant was lauded in 1857 by Virginia anti-slavery leader John Curtis Underwood, who wrote to Eli Thayer, "What a glory it would be to our country if it could elect this man to the Presidency-the country not he would be honored & elevated by such an event." In 1860 Bryant helped secure the Presidential nomination for Abraham Lincoln, and was instrumental in the choice of two key members of his cabinet, Salmon Chase as Secretary of the Treasury, and Gideon Welles as Secretary of the Navy. During disheartening delays and defeats in the early war years, direct communications from Union field commanders empowered his editorial admonitions to such a degree that the conductor of a national magazine concluded that the Evening Post's "clear and able political leaders have been of more service to the government of this war than some of its armies." Bryant's correspondence with statesmen further reflects the immediacy of his concern with military and political decisions. There are thirty-five known letters to Lincoln, and thirty-two to Chase, Welles, war secretary Stanton, and Senators Fessenden, Morgan, and Sumner. This seven-year passage in Bryant's life, beginning with his wife's critical illness at Naples in 1858, concludes with a unique testimonial for his seventieth birthday in November 1864. The country's leading artists and writers entertained him at a "Festival" in New York's Century Club, giving him a portfolio of pictures by forty-six painters as a token of the "sympathy" he had "ever manifested toward the Artists," and the "high rank" he had "ever accorded to art." Poets Emerson, Holmes, Longfellow, Lowell, and Whittier saluted him in prose and verse. Emerson saw him as "a true painter of the face of this country"; Holmes, as the "first sweet singer in the cage of our close-woven life." To Whittier, his personal and public life sounded "his noblest strain." And in the darkest hours of the war, said Lowell, he had "remanned ourselves in his own manhood's store," had become "himself our bravest crown."

Book A Book of Legal Lists

    Book Details:
  • Author : the late Bernard Schwartz
  • Publisher : Oxford University Press
  • Release : 1997-04-17
  • ISBN : 0198026943
  • Pages : 303 pages

Download or read book A Book of Legal Lists written by the late Bernard Schwartz and published by Oxford University Press. This book was released on 1997-04-17 with total page 303 pages. Available in PDF, EPUB and Kindle. Book excerpt: Who are the top ten greatest Supreme Court Justices of all time? Who are the worst ten? Which Supreme Court decision helped lead to the Civil War? What are the ten greatest and worst Supreme Court decisions? What are the ten best courtroom movies? Who was the last to use the Supreme Court spittoon? Who was the first Justice to wear trousers beneath his Supreme Court robes? From John Marshall, the greatest Supreme Court Justice, to Alfred Moore, one of the worst, Bernard Schwartz's A Book of Legal Lists--the first ever compiled--provides the Ten Bests and Worsts in American law (and also includes answers to 150 trivia questions about the legal world). The lists include the greatest dissents and Supreme Court "might have beens;" greatest non-Supreme Court judges (Lemuel Shaw, number one on the Greatest list, played a prominent role in recasting common law into an American mold); greatest and worst non-Supreme Court decisions; greatest law books; lawyers (including Alexander Hamilton, Clarence Darrow "Attorney for the Damned", and Abraham Lincoln); trials; and greatest legal motion pictures. Each list entry has a short essay by Schwartz explaining why it is a best or a worst, and it is in these essays that we gain a wealth of information about the legal world. We learn, for instance, that Sherman Minton, number ten on the Worst Supreme Court Justices list, was such a nonentity that he may be best remembered as the last to use the spittoon provided for each Justice behind the bench. Before he became Chief Justice, William H. Rehnquist was known for playing Trivial Pursuit on the bench, Oliver Wendell Holmes wrote 873 opinions for the Court (the most in its history), and Roger Brooke Taney, number ten on the Greatest Supreme Court Justices list, was the first Chief Justice to wear trousers beneath his robes (his predecessors had always given judgment in knee breeches). Stretching back to the early 1700s, the law and the judges who interpret it have maintained a steady presence in our lives--sometimes for better, sometimes for worse. From disappointments like Plessy v. Ferguson (number two on the Ten Worst Supreme Court Decisions list), which gave the lie to the American ideal "that all men are created equal," to lesser known but no less important decisions such as the 1933 United States v. One Book Called "Ulysses", (number nine on the Ten Greatest Non-Supreme Court Decisions) the landmark First Amendment case that eased the law governing censorship, Bernard Schwartz provides legal experts and non-experts alike with entertaining information in a format that can be found nowhere else.
