Download or read book Decentralization and Regional Autonomy in Indonesia written by Coen J G Holtzappel and published by Institute of Southeast Asian Studies. This book was released on 2009 with total page 463 pages. Available in PDF, EPUB and Kindle. Book excerpt: In 1999, Indonesia embarked on a reform of regional governance that brings self-governance to rural districts and municipalities, i.e., the administrative and democratic capacity needed to apply basic services like healthcare, national legislation and environment policies. This edited volume is the first book, which not only deals with the 1999 legislation but also shows how the deficiencies and contradictions of this legislation reduced implementation between 2001 and 2004 to a try-out. The book also discusses the adaptations that were the focus of the debate on the revision of the 1999 legislation that resulted in the 2004 update legislation and the amendment of the 1945 Constitution. Anthropological case studies of five provinces complement and deepen the findings of the more general survey reports.
Download or read book The Voice of the Law in Transition written by A. Massier and published by BRILL. This book was released on 2008-01-01 with total page 323 pages. Available in PDF, EPUB and Kindle. Book excerpt: In the literature on Indonesian legal history, the role of language has been paid scant attention. Even the replacement of Dutch by Indonesian as the official language of the law, surely a major event for the work of Indonesian jurists, has not been closely examined. Yet, since the early 1970s, legal usage and terminology have been the topic of a steady stream of highly critical publications by linguists and, remarkably, by jurists as well. Their criticism is focused on the heterogeneity of law language and terminology, and the deviation of legal usage from the official standard language. Government measures (language courses, law dictionaries) have not allayed this criticism. This study exposes two fundamental defects in the government measures and in the criticism itself. Firstly, they are grounded in an instrumental approach to language, an approach that sees language as a mere tool of the jurist, and as secondary in importance to the conceptual world that is considered law’s core business. Secondly, they greatly underestimate the impact of the declining knowledge of Dutch upon the development of Indonesian law language. Massier argues that the law must be viewed as inextricably bound up with the language in which it is formulated. Consequently, legal training and practice are examined in this study in terms of language behaviour and conventions, of learning, writing and speaking the languages of the law. The voice of the law in transition provides a language history of Indonesian law and its practitioners.

Download or read book The Decline of Constitutional Democracy in Indonesia written by Herbert Feith and published by Equinox Publishing. This book was released on 2007 with total page 648 pages. Available in PDF, EPUB and Kindle. Book excerpt: This is an intensive study of Indonesian politics from the attainment of full independence in December 1949 to the proclamation of martial law in March 1957, and President Soekarno's subsequent establishment of "guided democracy". It is intended as a contribution to the ongoing discussion of democracy in the new states of Asia and Africa, of the ways in which Western political institutions are transformed when employed in non-Western social settings, and of the obstacles to be overcome if such institutions are to operate in consonance with the authority systems of new nations and with their solution of economic and administrative problems. Now brought back into print as a member of Equinox Publishing's Classic Indonesia series, The Decline of Constitutional Democracy is considered to be the definitive study of Indonesia in the 1950s and will be of great interest to the growing number of social scientists concerned with the pre-industrial nations and in particular with their efforts to use and adapt Western political institutions. This is a solid and scholarly account, but, writing on the basis of much personal observation, Dr. Feith manages to present his material in such a way that readers with no previous background in the subject will be able to follow the book almost as easily as will specialists. HERBERT FEITH (1930-2001) became familiar with Indonesia during 1951-53 and 1954-56 when he was an English Language Assistant with the Ministry of Information of the Republic of Indonesia. A citizen of Australia, he received an M.A. degree from the University of Melbourne in 1955 and a Ph.D. from Cornell University in 1961. He was a Research Fellow in the Department of Pacific History, Australian National University, from 1960 to 1962 and was Chair of Politics at Monash University from 1968 until 1974.
Download or read book The Politics of Redress written by Peter Keppy and published by BRILL. This book was released on 2010-01-01 with total page 296 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book focuses on the aftermath of World War II in Asia as described in a sobering and insightful history of two types of redress: compensation for material war damage and restitution of looted property. Japanese Army units and citizens stole goods while shelling and bombardment by all sides destroyed factories, offices and residential neighbourhoods. How were these cases of material damage and loss to be rectified, and who was to rectify them? What financial means and legal precedents were there to fall back on at a time of decolonization, independence struggle, and shifting alliances on the brink of the Cold War? The politics of redress makes an important contribution to the study of law and society in Southeast Asia. It lays bare the complex web of interconnections between politics, law and economy from a comparative historical perspective. The translation of this book was funded by the Nederlandse Organisatie voor Wetenschappelijk Onderzoek (NWO, Netherlands Organisation for Scientific Research).
Download or read book Batavia Jakarta 1600 2000 written by Ewald Ebing and published by BRILL. This book was released on 2021-11-01 with total page 1048 pages. Available in PDF, EPUB and Kindle. Book excerpt: This is an odd book. An extensive and sometimes annotated bibliography, it is not a book in the sense of a narrative. However, if treated as a book in the traditional sense it leads the reader through a broad spectrum of feelings of amazement, curiosity and desire: amazement about the sheer volume, richness and detail of theliterature on Batavia/Jakarta; curiosity about the contents of certain publications or series of publications with attractive titles; and a feeling of desire immediately to begin an investigation into one of the appealing subjects stumbled upon while leafing through. The bibliography contains over 5000 titles classified into 42 broad subject categories. The vast majority of the publications consists of books, but the number of articles is also very substantial. Most of these titles (3500) were produced after 1950. The larger part of the publications are written in Indonesian, Dutch, and to a lesser extent English. But also publications in such languages as French, Chinese, German, Japanese, Russian, and many others were listed. Indexes of authors, of subjects and of titles make this bibliography easily accessible.

Download or read book Copyright Property and the Social Contract written by John Gilchrist and published by Springer. This book was released on 2018-11-02 with total page 292 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book provides international perspectives on the law of copyright in relation to three core themes - copyright and developing countries; the government and copyright; and technology and the future of copyright. The third theme includes an examination of the extent to which technology will dictate the development of the law, and a re-examination of the role of copyright in fostering innovation and creativity. As a critique, one chapter discusses how certain rights can create or reinforce social inequality under copyright royalty systems. Underlying these themes is the role the law of copyright has in encouraging or impeding human flourishing.
