Book excerpt: Democracy means rule by the people, but in practice even the most robust democracies delegate most rule making to a political class The gap between the public and its representatives might seem unbridgeable in the modern world, but Legislature by Lot examines an inspiring solution: a legislature chosen through “sortition”—the random selection of lay citizens. It’s a concept that has come to the attention of democratic reformers across the globe. Proposals for such bodies are being debated in Australia, Belgium, Iceland, the United Kingdom, and many other countries. Sortition promises to reduce corruption and create a truly representative legislature in one fell swoop. In Legislature by Lot, John Gastil and Erik Olin Wright make the case for pairing a sortition body with an elected chamber within a bicameral legislature. Gastil is a leading deliberative democracy scholar, and Wright a distinguished sociologist and editor of the Real Utopias series, of which this is a part. In this volume, they bring together critics and advocates of sortition who have studied ancient Athens, deliberative polling, political theory, social movements, and civic innovation. Without obscuring its limitations, the contributors offer a wide variety of ideas for how to implement sortition and examine its potential for reshaping modern politics. Legislature by Lot includes sixteen essays that respond to Gastil and Wright’s detailed proposal. Essays comparing sortition to contemporary reforms see it as a dramatic extension of deliberative “minipublics,” which gather random samples of citizens to weigh public policy dilemmas without being empowered to enact legislation. Another set of essays explores the democratic principles underlying sortition and elections and considers, for example, how a sortition body holds itself accountable to a public that did not elect it. The third set of essays considers alternative paths to democratic reform, which limit the powers of a sortition chamber or more quickly establish a pure sortition body. Constituent instructions were more widely issued than previously thought, and members of state legislatures and Congress were more likely to obey them than political scientists and historians have assumed. Peverill Squire expands our understanding of constituent instructions beyond a handful of high-profile cases, through analyses of two unique data sets: one examining more than 5,000 actionable communications (instructions and requests) sent to state legislators by constituents through town meetings, mass meetings, and local representative bodies; the other examines more than 6,600 actionable communications directed by state legislatures to their state’s congressional delegations. He draws the data, examples, and quotes almost entirely from original sources, including government documents such as legislative journals, session laws, town and county records, and newspaper stories, as well as diaries, memoirs, and other contemporary sources. Squire also includes instructions to and from Confederate state legislatures in both data sets. In every respect, the Confederate state legislatures mirrored the legislatures that preceded and followed them.

While they enjoy the freedom to stand for office and therefore have an equal legal footing with men, this persistent gender imbalance raises pressing questions about democratic legitimacy, the inclusivity of American politics, and the quality of political representation. The reasons for women's underrepresentation remain the subject of much debate. One explanation--that the United States lacks sufficient openings for political newcomers--has become less compelling in recent years, as states that have adopted term limits have not seen the expected gains in women's office holding. Other accounts about candidate scarcity, gender inequalities in society, and the lingering effects of gendered socialization have some merit; however, these accounts still fail to explain the relatively low numbers. Drawing upon original surveys conducted in 1981 and 2008 by the Center for American Women and Politics (CAWP) of women state legislators across all fifty states, and follow-up interviews after the 2008 survey, the authors find that gender differences in pathways to the legislatures, first evident in 1981, have been surprisingly persistent over time. They find that, while the ambition framework better explains men's decisions to run for office, a relationally embedded model of candidate emergence better captures women's decision-making, with women's decisions more often influenced by the encouragement and support of parties, organizations, and family members. By rethinking the nature of women's representation, this study calls for a reorientation of academic research on women's election to office and provides insight into new strategies for political practitioners concerned about women's political equality.

Book excerpt: Campaign contributions are widely viewed as a corrupting influence but most scholarly research concludes that they have marginal impact on legislative behavior. Lynda W. Powell shows that contributions have considerable influence in some state legislatures but very little in others. Using a national survey of legislators, she develops an innovative measure of influence and delineates the factors that explain this great variation across the 99 U.S. state legislative chambers. Powell identifies the personal, institutional, and political factors that determine how much time a legislator devotes to personal fundraising and fundraising for the caucus. She shows that the extent of donors' legislative influence varies in ways corresponding to the same variations in the factors that determine fundraising time. She also confirms a link between fundraising and lobbying with evidence supporting the theory that contributors gain access to legislators based on donations, Powell's findings have important implications for the debate over the role of money in the legislative process.
