Book excerpt: Argues that cultural conceptions of children – and childhood – played a key role in legalizing gay marriage Legally Straight offers a critical reading of the legal debates over lesbian and gay marriage in the United States. The book draws on key judicial opinions to trace how our understanding of heterosexuality and marriage has changed. Upon closer inspection, it seemed that the cultural value of marriage was becoming tarnished and the trouble appeared to center on one very specific issue: reproduction. As opponents of lesbian and gay marriage emphasized the link between marriage and accidental pregnancy, the evidence mounted, the arguments proliferated, and resistance began to turn against itself. Heterosexuality, it seemed for a moment, was little more than a set of palliative prescriptions for the worst of human behavior, and children became the victims. It thus became the province of the courts to reinforce the cultural value of marriage by resisting what came to be known as the “procreation argument,” the assertion that marriage exists primarily to regulate the unruly aspects of heterosexual reproduction. Cultural conceptions of children and childhood were being put at risk as gays and lesbians were denied marriage, so that writing lesbian and gay families into the marriage law became the better option.

In The Gang’s All Queer, Vanessa Panfil introduces us to a different world. Meet gay gang members – sometimes referred to in popular culture as “homo thugs” – whose gay identity complicates criminology’s portrayal and representation of gangs, gang members, and gang life. In vivid detail, Panfil provides an in-depth understanding of how gay gang members construct and negotiate both masculine and gay identities through crime and gang membership. The Gang’s All Queer draws from interviews with over 50 gay gang- and crime-involved young men in Columbus, Ohio, the majority of whom are men of color in their late teens and early twenties, as well as on-the-ground ethnographic fieldwork with men who are in gay, hybrid, and straight gangs. Panfil provides an eye-opening portrait of how even members of straight gangs are connected to a same-sex oriented underground world. Most of these young men still present a traditionally masculine persona and voice deeply-held affection for their fellow gang members. They also fight with their enemies, many of whom are in rival gay gangs. Most come from impoverished, ‘rough’ neighborhoods, and seek to defy negative stereotypes of gay and Black men as deadbeats, though sometimes through illegal activity. Some are still closeted to their fellow gang members and families, yet others fight to defend members of the gay community, even those who they deem to be “fags,” despite distaste for these flamboyant members of the community. And some perform in drag shows or sell sex to survive. The Gang’s All Queer poignantly illustrates how these men both respond to and resist societal marginalization. Timely, powerful, and engaging, this book will challenge us to think differently about gangs, gay men, and urban life.

Book excerpt: Using the contemporary workings of property law in India through the lives and thoughts of middle-class and poor women, this is a study of the ways in which cultural practices, and particularly notions of gender ideology, guide the workings of law. It urges a close reading of decisions by women that appear to be contrary to material interests and that reinforce patriarchal ideologies. Hailed as a radical moment for gender equality, the Hindu Succession Act was passed in India in 1956 theoretically giving Hindu women the right to equal inheritance of their parents’ self-acquired property. However, in the years since the act’s existence, its provisions have scarcely been utilized. Using interview data drawn from middle-class and poor neighborhoods in Delhi, this book explores the complexity of women’s decisions with regard to family property in this context. The book shows that it is not passivity, ignorance of the law, naiveté about wealth, or unthinking adherence to gender prescriptions that guides women’s decisions, but rather an intricate negotiation of kinship and an optimization of socioeconomic and emotional needs. An examination of recent legal cases also reveals that the formal legal realm can be hospitable to women’s rights-based claims, but judgments are still coded in terms of customary provisions despite legal criteria to the contrary.
