Book excerpt: Using the high-profile 2017 blasphemy trial of the former governor of Jakarta, Basuki ‘Ahok’ Tjahaja Purnama, as its sole case study, this book assesses whether Indonesia’s liberal democratic human rights legal regime can withstand the rise of growing Islamist majoritarian sentiment. Specifically, this book analyses whether a 2010 decision of Indonesia’s Constitutional Court has rendered the liberal democratic human rights guarantees contained in Indonesia’s 1945 Constitution ineffective. Key legal documents, including the indictment issued by the North Jakarta Attorney-General and General Prosecutor, the defence’s ‘Notice of Defence’, and the North Jakarta State Court’s convicting judgment, are examined. The book shows how Islamist majoritarians in Indonesia have hijacked human rights discourse by attributing new, inaccurate meanings to key liberal democratic concepts. This has provided them with a human rights law-based justification for the prioritisation of the religious sensibilities and religious orthodoxy of Indonesia’s Muslim majority over the fundamental rights of the country’s religious minorities. While Ahok’s conviction evidences this, the book cautions that matters pertaining to public religion will remain a site of contestation in contemporary Indonesia for the foreseeable future. Despite the recent visibility of the Kurds in the international media, little is known about their political aspirations as citizens of an autonomous region. In Secession and Conflict Zheger Hassan employs a comparative analysis to explore why Iraqi Kurdistan, despite being better positioned institutionally and economically than the similar cases of South Sudan and Kosovo, has not declared independence. In rebuilding Iraq and fighting against the Islamic State, the Kurds have cultivated important political alliances with the US and Europe, which have garnered them international economic, military, and political support. Though now well-positioned to function as an independent state, Iraqi Kurdistan has vacillated in seizing this golden opportunity to declare independence. The apparent Kurdish willingness to forgo independence runs counter to the prevailing narratives about the Kurds in the Middle East. Hassan draws not only on the history of the Kurds but also on first-hand interviews with high-ranking officials, journalists, and nationalists to provide a new window into the calculations of Kurdish leaders as they navigate the complicated politics of Iraq. Yet the duel was also an act of potentially deadly violence and a challenge to the authority of statutory law. When duelling became widespread in early twentieth-century Uruguay, legislators facing this dilemma chose the unique and radical path of legalization. The Pen, the Sword, and the Law explores how the only country in the world to decriminalize duelling managed the tension between these informal but widely accepted “gentlemanly laws” and its own criminal code. The duel, which remained legal until 1992, was meant to ensure civility in politics and decorum in the press, but it often failed to achieve either. Drawing on rich and detailed newspaper reports of duels and challenges, parliamentary debates, legal records, private papers, and interviews, David Parker examines the role of pistols and sabres in shaping the everyday workings of a raucous public sphere. The Dois de Julho (2 July) festival celebrates the day the Portuguese troops were expelled from Salvador in 1823, the culmination of a year-long war that gave independence a radical meaning in Bahia. Bahia's Independence traces the history of the Dois de Julho festival in Salvador, the Brazilian state's capital, from 1824 to 1900. Hendrik Kraay discusses how the festival draws on elements of saints' processions, carnivals, and civic ritual in the use of such distinctive features as the indigenist symbols of independence called the caboclos and the massive procession into the city that re-enacts the patriots' victorious entry in 1823. Providing a social history of celebration, Kraay explains how Bahians of all classes, from slaves to members of the elite, placed their stamp on the festivities and claimed recognition and citizenship through participation. Analyzing debates published in newspapers – about appropriate forms of commemoration and the nature of Bahia's relationship to Brazil – as well as theatrical and poetic representations of the festival, this volume unravels how Dois de Julho celebrations became so integral to Bahia's self-representation and to its politics. The first history of this unique festival's origins, Bahia's Independence reveals how enthusiastic celebrations allowed an active and engaged citizenry to express their identity as both Bahians and Brazilians and to seek to create the nation they desired.
