Book excerpt: Legislating for the ecosystem approach to fisheries (EAF) is complex, due to the holistic nature of the EAF involving multiple factors that underpin the social, economic, environmental, and institutional aspects of fisheries sustainability. These factors include ecosystems integration, risks, intersectoral collaboration, research, participatory processes, monitoring, control, surveillance, and enforcement, among others. To assess how the EAF is being implemented through national policy and legal frameworks, FAO developed A diagnostic tool for implementing an ecosystem approach to fisheries through national policy and legal frameworks. The present legal report on the EAF used the diagnostic tool to assess the alignment of selected policy and legal instruments of Cabo Verde with the EAF. This assessment analysed the extent to which 82 EAF legal requirements, which are considered the minimum standards in legislating for the EAF, are reflected in Cabo Verde's policies and legislation relevant to the fisheries sector of the country and other relevant sectors (such as environment, wildlife, ecosystems, and maritime affairs). Based on this preliminary diagnosis, gaps were identified in the assessed instruments, and recommendations were made for improving the implementation of the EAF. This report was elaborated following a participatory approach with the involvement of the national competent authorities of Cabo Verde. Drafted in July 2021, the report was submitted to the national authorities of Cabo Verde in October 2021, further revised in view of the adoption of additional relevant legal instruments by Cabo Verde and the integration of the conclusions and recommendations from the Coastal Fisheries Initiative Report from August 2022. The report was re-submitted to the national authorities in October 2022. The National Directorate of Fisheries and Aquaculture, under the Ministry of the Sea, endorsed this EAF Legal Report of Cabo Verde in October 2022.

Book excerpt: The ecosystem approach to fisheries (EAF) is a risk-based management process for the planning, management, development, regulation and monitoring of fishing and fishing-related activities. EAF addresses ecological consequences of fishing as well as social, economic and institutional aspects of fisheries sustainability. Adequate legislation and regulatory frameworks are key to successful implementation of the EAF. The continuous review and update of information on legislation and regulatory instruments require the analysis of existing legal frameworks at all levels of governance, to assess whether they remain in force, valid and aligned with international fisheries law standards, including the EAF. The present work was prepared with a view to provide current information on how the EAF is being implemented through national legal frameworks of selected countries in Africa. It revisits a previous legal study prepared by Anniken Skonhoft and published by FAO in 2011. A decade later, based on the scope of that study, the present work provides updated data and contributes to the knowledge on the current global and regional legal frameworks for an EAF, which are vital for EAF implementation purposes. This update also re-analysed certain countries’ national legislation and their evolution with respect to capturing the EAF requirements. Ultimately, the present work supports the legal implementation of an EAF for a holistic, integrated and innovative way of managing fisheries that promotes the participation of all relevant stakeholders and the use of best available knowledge for decision making, whilst balancing the human dimensions with the care for the environment, habitats, ecosystems and biodiversity related with fishery resources on which they depend.

Book excerpt: Many coastal fisheries are poorly managed and overexploited, resulting in suboptimal yields and lost revenue, and damage to other species and habitats. The Coastal Fisheries Initiative (CFI) is a global effort between FAO and other development partners to address these issues in a holistic and integrated way. It aims to work at a practical level with selected fisheries and to facilitate a global exchange of experience and learning. The CFI comprises subsidiary regional projects in Indonesia, Latin America and West Africa, a sustainable investment support project, and a global partnership and coordination project. The mid-term evaluation of the global coordination project found that, while the initiative is extremely relevant, it has so far had limited impact of a strengthened global partnership. The evaluation recommended greater coordination between the subsidiary projects, a strengthened reporting structure and a project extension of up to two years.

Transboundary Diagnostic Analysis (TDA) and a Strategic Action Programme (SAP) were achieved despite difficult working contexts. By formally adopting the SAP, participating countries confirmed their interest in and commitment to the ecosystem-based approach to marine and coastal resource management. Continuation of this success all depends on activities during the transition phase, which aim to enhance scientific achievements of the project and seek synergies with other national and regional initiatives. It is a key tool for use by any actor, including small-scale fishers, who is interested in contributing to the SSF Guidelines operationalization at the national level. By using this tool, users are able to recognize the national policy and legal instruments that are relevant to small-scale fisheries in a country, consistent with the SSF Guidelines. Users are also able to: assess policy coherence for SSF; assess the alignment of national fisheries policy and legal instruments with the SSF Guidelines; identify gaps and strengths in these instruments; and further propose recommendations for improving the existing national policy and legal framework according with the SSF Guidelines.

Book excerpt: The regional dimension is key to international fisheries management policy, as demonstrated by the rapid expansion of the family of regional fisheries bodies (RFBs). There are some 50 RFBs worldwide. Most provide only advice to their members, and are hence referred to in this work as regional fisheries advisory bodies (RFABs). Regional fisheries management organizations (RFMOs) have mandates to adopt legally binding conservation and management measures based on the best scientific evidence. Global instruments and normative processes have to be implemented and translated into actions at the country and regional levels, as appropriate. In this regard, regionalization of fisheries and aquaculture governance can provide opportunities not only to address common concerns, create synergies and mainstream the global objectives of relevant UN bodies, but also to broaden outreach on the global fisheries agenda to regional partners that may not be directly concerned with fisheries, as well as to the general public. The present study provides an overview of the activities and developments of RFMOs and RFABs from 2000 to 2017. It is based on a compilation of data and information for 46 RFMOs and RFABs.

[Author] The project, initiated in December 2018, was designed under the FAO Umbrella Programme for the Promotion and Application of the SSF Guidelines (PGM/MUL/2015-2020/SSF) – Enhancing the contribution of small-scale fisheries to food security and sustainable livelihoods. [Author] Activities under the project first started in Cabo Verde, Costa Rica, Côte d’Ivoire, Madagascar, Myanmar, Namibia, Oman, Philippines, Senegal and United Republic of Tanzania. [Author] In subsequent phases of the project, support was further extended upon ad hoc requests to other countries, such as Mozambique, and to a number of small-scale fisheries organizations, civil society orgranizations (CSOs) and NGOs. Book excerpt: FAO has promoted the ecosystem approach to fisheries (EAF) as an appropriate framework for the sustainable development and management of fisheries worldwide. With a view to contribute to the identification of lessons and good practices for EAF implementation, this publication documents nine case studies that attempted to put into practice some of the key principles and tools of the approach in the Mediterranean Sea. The case studies were selected to cover a broad range of contexts including smallscale and industrial fisheries operating at local, national and sub-regional scales. It was not within the scope of the publication to evaluate the level of implementation of the ecosystem approach. A specific tool for monitoring implementation is proposed and exemplified. Case studies were analysed with a view to draw preliminary lessons regarding the enabling factors that facilitated the progress made as well as the challenges faced in the transition towards EAF-based management systems. Attention is drawn to key enabling conditions such as favourable policies, legislation and regulatory frameworks, the existence of regional mechanisms for cooperation, favourable market dynamics and social processes, and the relatively low complexity of the fishery systems analysed. A set of factors emerged that contributed to progress during implementation, such as the clear definition of fishing rights, the enhancement of mechanisms for compliance, scientific monitoring and adaptation of management measures, as well as the explicit consideration of biological and socioeconomic aspects in management actions. Further progress in the transition towards sustainable management systems is hampered by external and internal factors. External factors are related, for instance, to environmental changes, the poor regulation and control of competing sectors, consumer behaviour and the governance environment. Issues such as stakeholder representation, knowledge gaps and the availability of sustainable sources of funding are among common internal factors. The authors also discuss how slow progress in the implementation of management plans can generate discredit with the institutions and add additional challenges for any future initiatives to engage stakeholders in participatory management. The case-based results and lessons of how the ecosystem approach to fisheries was considered, developed and implemented in the fisheries discussed in this publication not only contribute to the documentation of current practices in the Mediterranean but may also guide future attempts to further develop the field.

The Declaration calls for support for “an evolving and positive vision for fisheries and aquaculture in the twenty first century, where the sector is fully recognized for its contribution to fighting poverty, hunger and malnutrition.” In this context, Part 1 of this edition of The State of World Fisheries and Aquaculture reviews the world status of fisheries and aquaculture, while Parts 2 and 3 are devoted to Blue Transformation and its pillars on intensifying and expanding aquaculture, improving fisheries management and innovating fisheries and aquaculture value chains. Blue Transformation emphasizes the need for forward-looking and bold actions to be launched or accelerated in coming years to achieve the objectives of the Declaration and in support of the 2030 Agenda.
