Book A Bibliography of Legal Festschriften

Download or read book A Bibliography of Legal Festschriften written by L.M. Roberts and published by Springer Science & Business Media. This book was released on 2012-12-06 with total page 187 pages. Available in PDF, EPUB and Kindle. Book excerpt: The idea of compiling a bibliography of legal Festschriften originated with Lilly Roberts, and represented the most important creative side of her life during the last ten years of her association with the Universi ty of Michigan Law Library. The project received advice and counsel from the Foreign Law Com mittee of the American Association of Law Libraries. The final publi cation was made possible by an allocation from the grant made to the University of Michigan Law School by the Ford Foundation for re search in International and Comparative Law. Beverley J. Pooley Professor of Law Director of the Law Library University of Michigan PREFACE The present bibliography is international in scope; it covers Fest schriften published in many countries. It includes Festschriften from 1868 (date of the earliest legal Festschrift found) through December, 1968. A bibliography of all legal Festschriften, to be complete, could only be achieved through the cooperative effort of an international group of experts. The present bibliography is based on notes gathered by the compiler over a period of years from material available at the University of Michigan Law Library. It is therefore, inevitably, incom plete and occasionally inaccurate and must be considered as a tentative list, subject to implementation and correction at other legal centers. It was felt, however, that its publication might be of some use, since not enough bibliographical information about this important and steadily growing type of legal literature exists.

Book Contract Law

    Book Details:
  • Author : Adam Kramer QC
  • Publisher : Bloomsbury Publishing
  • Release : 2010-01-02
  • ISBN : 1847317286
  • Pages : 250 pages

Download or read book Contract Law written by Adam Kramer QC and published by Bloomsbury Publishing. This book was released on 2010-01-02 with total page 250 pages. Available in PDF, EPUB and Kindle. Book excerpt: This is a new type of book. It provides an index of the most useful and important academic and other writings on contract law, whether published in articles or journal chapters, or as books. These writings, with their full citation, are gathered under familiar contract law subject-headings, and the most significant half of them are digested in a summary of a few lines each. The book aims to cover all writings published in the English language about the Common Law of contracts, and includes sections on contract theory and the history of contract law, as well as sections for the more traditional substantive topics (such as the interpretation of contracts, penalty clauses, remoteness of damage and anticipatory breach). This work should prove an invaluable resource for practitioners, academics and students, increasing awareness of important writings, and saving readers time by familiarising them with the work that has already been done in their particular fields.

Book International Legal Argument in the Permanent Court of International Justice

Download or read book International Legal Argument in the Permanent Court of International Justice written by Ole Spiermann and published by Cambridge University Press. This book was released on 2005-01-06 with total page 539 pages. Available in PDF, EPUB and Kindle. Book excerpt: The International Court of Justice at The Hague is the principal judicial organ of the UN, and the successor of the Permanent Court of International Justice (1923–1946), which was the first real permanent court of justice at the international level. This 2005 book analyses the groundbreaking contribution of the Permanent Court to international law, both in terms of judicial technique and the development of legal principle. The book draws on archival material left by judges and other persons involved in the work of the Permanent Court, giving fascinating insights into many of its most important decisions and the individuals who made them (Huber, Anzilotti, Moore, Hammerskjöld and others). At the same time it examines international legal argument in the Permanent Court, basing its approach on a developed model of international legal argument that stresses the intimate relationships between international and national lawyers and between international and national law.

Book International Legal Personality

Download or read book International Legal Personality written by Fleur Johns and published by Routledge. This book was released on 2017-07-05 with total page 553 pages. Available in PDF, EPUB and Kindle. Book excerpt: Who or what is entitled to act on the international plane? Where should responsibility for violations of international law lie? What sort of entities are capable of possessing international legal rights? What is the status of individuals, minority groups, non-governmental bodies, international organisations and animals in the international legal order and how has their status shifted over time? International Legal Personality contains fourteen articles that address these and related questions. In historical and contemporary writings, international lawyers grapple with the nature of legal identity, and confront global distributions of authority and responsibility, as they explore who or what is a 'person' in the international legal order. These essays document the emergence of an international legal order increasingly conceived in terms of patterns and probabilities, rather than as the stagecraft of a small company of permanent players.

Book The Fiercest Debate

  • Publisher : University of Toronto Press
  • Release : 1987-12-15
  • ISBN : 148759108X

Download or read book The Fiercest Debate written by C. Ian Kyer and published by University of Toronto Press. This book was released on 1987-12-15 with total page 360 pages. Available in PDF, EPUB and Kindle. Book excerpt: From its earliest days the Law Society of Upper Canada adhered to the traditions of English legal practice and education. In the 1930s and 1940s, however, some of the most cherished of those traditions were challenged in a bitter debate about the nature of legal education in Ontario. This book tells the story of that debate and one of its leading participants, Cecil Augustus Wright. 'Caesar' Wright was one of the first Canadian legal academics to attend Harvard Law School, and his Harvard background played a significant role in the development of his position in the controversy over legal education. The established lawyers who served as benchers of the law society insisted that legal training should be principally a matter of practical experience. Wright, who sought to bring American notions of the roles of lawyers and legal academic to Ontario, tried unsuccessfully to persuade the benchers that the job of educating young lawyers should be transferred to the universities. Decades of contention culminated in 1949 with Wright's dramatic resignation from Osgoode Hall Law School and his appointment as dean of the newly created Faculty of Law at the University of Toronto. The debate between the benchers of the law society and the proponents of academic legal education touched the lives of many prominent lawyers and law professors, and its resolution permanently changed the nature of legal education in Ontario. Ian Kyer and Jerome Bickenbach offer an account of the conflict and a portrait of the energetic and often acerbic figure who has been called Canada's most influential law teacher.

Book Unconstitutional Constitutional Amendments

Download or read book Unconstitutional Constitutional Amendments written by Yaniv Roznai and published by Oxford University Press. This book was released on 2017-02-16 with total page 368 pages. Available in PDF, EPUB and Kindle. Book excerpt: Can constitutional amendments be unconstitutional? The problem of 'unconstitutional constitutional amendments' has become one of the most widely debated issues in comparative constitutional theory, constitutional design, and constitutional adjudication. This book describes and analyses the increasing tendency in global constitutionalism to substantively limit formal changes to constitutions. The challenges of constitutional unamendability to constitutional theory become even more complex when constitutional courts enforce such limitations through substantive judicial review of amendments, often resulting in the declaration that these constitutional amendments are 'unconstitutional'. Combining historical comparisons, constitutional theory, and a wide comparative study, Yaniv Roznai sets out to explain what the nature of amendment power is, what its limitations are, and what the role of constitutional courts is and should be when enforcing limitations on constitutional amendments.
