Book excerpt: It has been said that the measure of a healthy and civilized society is how well it treats its elderly and indigent. Perhaps it should be said also that the measure of the health of religious liberty in a society is the degree to which minority, nontraditional faiths are protected. This book is a collection of essays on the subject of religious liberty and new religious movements (NRMs). NRMs are often called "cults" by popular media commentators and the public at large, but scholars eschew that term because it is so pejorative that it skews the argument from the very beginning. By contrast, the term "new religious movements" attempts to place NRMs squarely in the mix with older, more traditional forms of religion. This is due in part to the fact that in America there should be no correlation between the level of social approval a group has achieved and the degree of religious liberty it enjoys. As the Supreme Court itself averred famously in the 1872 case Watson v. Jones, "The Law knows no heresy and is committed to the support of no dogma, the establishment of no sect." Each author represented in this volume believes that NRMs should enjoy the same liberties as more mainstream religions. If the book has a bias, it is a bias in favor of religious liberty. There has already been a lively debate concerning the structural context in which abuse, especially sexual abuse, can be perpetrated within religion. Contributors to the volume proceed from the premise that similar arguments about ways in which structure and power may be conducive to abuse can be made about fraud and deception. Both can contribute to abuse, yet they are often less easily demonstrated and proven, hence less easily prosecuted. With a focus on minority religions, the book offers a comparative overview of the concept of religious fraud by bringing together analyses of different types of fraud or deception (financial, bio-medical, emotional, breach of trust and consent). Contributors examine whether fraud is necessarily intentional (or whether that is in the eye of the beholder); certain structures may be more conducive to fraud; followers willingly participate in it. Book excerpt: This book examines the interpretation and application of the right to freedom of religion and belief of new minorities formed by recent migration by the European Court of Human Rights (ECtHR) and the United Nations Human Rights Committee (HRC). New minorities are increasingly confronted with restrictions of their religious practices and have addressed their rights claims both to the ECtHR and the HRC through their individual complaint procedures, which resulted in several contradicting decisions. Based on a quantitative and qualitative empirical analysis of the relevant case law, focusing in particular on the reasoning adopted by the two bodies, this book finds that the HRC in its practice offers a significantly higher level of protection to new minorities than the ECtHR. Such divergence may be explained by various institutional and conceptual differences, of which the concept of the margin of appreciation is the most influential. It is contended that the extensive use of the concept of the margin of appreciation by the ECtHR in the case law regarding new minorities’ right to freedom of religion and belief, and the absence of such concept in the HRC’s case law, could be explained by different understandings of the role of an international human rights body in conflicts between the majority and minorities. This book argues that such divergence could be mitigated with various tools, such as the inclusion of cross-references to the case law of other relevant bodies as well as to instruments specifically established for the protection of minorities. The book will be of interest to academics, researchers and practitioners in the area of international human rights law, international public law in general and law and religion.
