Book excerpt: Fifty years after the famous essay “The Problem of Social Cost” (1960) by the Nobel laureate Ronald Coase, Law and Economics seems to have become the lingua franca of American jurisprudence, and although its influence on European jurisprudence is only moderate by comparison, it has also gained popularity in Europe. A highly influential publication of a different nature was the Brundtland Report (1987), which extended the concept of sustainability from forestry to the whole of the economy and society. According to this report, development is sustainable when it “meets the needs of the present without compromising the ability of future generations to meet their own needs”. A key requirement of sustainable development is justice to future generations. It is still a matter of fact that the law as well as the theories of justice are generally restricted to the resolution of conflicts between contemporaries and between people living in the same country. This in turn raises a number of questions: what is the philosophical justification for intergenerational justice? What bearing does sustainability have on the efficiency principle? How do we put a policy of sustainability into practice, and what is the role of the law in doing so? The present volume is devoted to these questions. In Part One, “Law and Economics”, the role of economic analysis and efficiency in law is examined more closely. Part Two, “Law and Sustainability”, engages with the themes of sustainable development and justice to future generations. This type of reasoning is being used to justify the destruction of social rights of citizens for the profit of the private sector, resulting in more limited access to the most fundamental resources such as water, nature, housing, culture, knowledge and information, mainly for the most vulnerable members of society. Such a view, informed solely by short-term growth and profit cycles, is endangering access to those resources not only for current generations but for future ones as well. This book is an attempt to go beyond liberal approaches to intergenerational and distributive justice. It emphasises the role of commons and communities of the commons, driven by the desire to defend and perpetuate those fundamental resources under the threat of expropriation by the state and the market. This book also offers policy makers and citizens, who wish to accept their political responsibility by being active and refusing corporate ideology, some best practices as well as methods and solutions for renewing the configurations of societal relationships through commons, thereby integrating the interests of future generations in the European Community’s decision-making processes and institutions. The argument is based on a close study of Rawls' theory of justice and particularly of its treatment of the future generations issue. But the author claims that the affirmation of a principle of justice towards future generations must be accompanied by the attempt to articulate the motives that shape a concern with the fate of future persons in the first place. In order to consider, and further, its real chances, we must put the perspective of justice between generations, with its very detached character, within the context of our view from the present such as it is situated in historical time. This opens a fascinating but difficult field of inquiry about inter-generational value and its different aspects. Although it is centred on the theory of justice and on general ethics, the book also pays attention to the legal issues raised by the notion of a future-oriented just basic structure of society.

He exposes a critical flaw in the dominant policy paradigm of risk assessment and cost-benefit analysis, which asks policymakers to, in essence, "regulate from nowhere." As Kysar shows, such an objectivist stance fails to adequately motivate ethical engagement with the most pressing and challenging aspects of environmental law and policy, which concern how we relate to future generations, foreign nations, and other forms of life. Indeed, world governments struggle to address climate change and other pressing environmental issues in large part because dominant methods of policy analysis obscure the central reasons for acting to ensure environmental sustainability. To compensate for these shortcomings, Kysar first offers a novel defense of the precautionary principle and other commonly misunderstood features of environmental law and policy. He then concludes by advocating a movement toward environmental constitutionalism in which the ability of life to flourish is always regarded as a luxury we "can" afford.
