To supple ment and illustrate the statements of legal principles which are set forth in the various treatises upon this subject. Object lessons, show ing the application of principles, are as efficacious in the study of law as in the study of other branches of learning, and such lessons are afforded by the actual decisions made by the courts in specific instances. Such decisions may also exhibit the growth and development of legal doctrines. The aim has been to select the most valuable and important cases that could be found, giving a comprehensive view of the particular point or question discussed, and presenting the actual living law of to-day as the result of the long process of adjudication in England and in this country. Hence the volume comprises modern cases to a large extent, and in some instances these are among the most recent that have been issued. The cases are printed in the same general form in which they ap pear ih the regular reports, viz., with head - notes, statements of facts, and sometimes arguments of counsel, prefixed to the Opinions. Run ning head-lines in bold-faced type, also, direct the attention of the reader to the principle treated of in the particular case that follows. Numerous other valuable cases are also cited after each of those that are printed in full, so that the reader can extend his researches more widely, if he so desires. The author has confined himself to a consideration of the typical branches of the subject, omitting bailments, marine torts, Statutory torts, and the torts of persons under legal disability. To introduce these with proper fulness would have required such a curtailing of the main branches of the subject as to destroy in a great measure the practical usefulness of the book. They were therefore omitted and reserved for future consideration, should it ever become desirable to add another volume to the work. It may be observed, however, that the topics mentioned are often incidentally presented, and their leading doctrines touched upon. Even with these omissions, it was not possible to consider in detail all of the law relating to the main branches of the subject. Slander, Trespasses upon Property, and Negligence have each been treated in text-books as large as the present volume. As to these subjects, and as to one or two others, the author was governed by the same considerations as in deciding upon the omissions above mentioned. It was thought best to present the central and prominent features of these topics in full detail, leav ing the rest for incidental mention and illustration. Not all the requisites of ultimate liability are here considered; the element of blame is not treated. It is left for a more particular study of the law of Torts to de termine what degree of intention, malice or negligence must exist before one may be forced to make compensation for a wrong; and for a study of Criminal Law to determine how far a guilty mind is requisite before punishment can be inflicted. The topics here considered are those fundamental ones which are a common element of torts and crimes; and the object of this collection is to prevent that duplication of effort which has heretofore existed through the attempt to include instruction in these topics in courses on Torts and on Criminal Law. The editor can claim little credit for the selection of the cases here collected.
