I have arranged them so that the reader perusing them in order will find the law systematically developed in groups of doctrines easy to be understood and remembered when their relation is thus made visible. Every attorney is becoming familiar with the disposition of appellate courts to press with increasing strictness the necessity of clearness and precision in framing the questions put on the trial so as to bring out legal evidence without drawing improper and prejudicial statements before the jury; while at the same time they require with the like increasing strictness, that objections be so specifically stated in the trial court, as to enable the judge clearly to understand the ground, and the adverse counsel to change his question or his offer so as to obviate the objection if it be one which can be obviated. In the selection of cases I have had in view the great practical importance of promoting regularity in the trial court, in these respects; and (except in a few cases where it has seemed unnecessary) I have prefixed to the opinion, as reported in the books, a statement from the record, which I have examined for the purpose, of the facts material to the point of evidence, and the colloquy between judge, counsel, and witness, at the trial, to enable the reader to see the exact line of discrimination which the appellate courts have drawn between obscurity and clearness in question and objection. I trust that this volume will be useful both to the bench and to the bar in aiding, alike, to avoid mistake and error, and to secure efficacious objections such as will preserve to the unsuccessful party his rights on appeal. I believe that nothing could be more advantageous to the profession than a better common understanding of the rules of forensic contest, so that less time may be lot and fewer disappointments incurred by fruitless controversy upon questions of irregularity, and less prejudice to litigants by erroneous procedure. The chief additional feature of this edition is the collection of Statutes on Evidence, forming Part II. Of the book. I have taken much trouble to select all the important statutory provisions relating to evidence, including those contained in statutes dealing with other matters but having special provisions as to evidence. I believe this collection to be the fullest in existence on the subject. I have not attempted to make it absolutely complete, as it would be useless, and wasteful of space, to insert some of the provisions on special matters. But I believe that every statutory provision on the subject, likely to be required, will be found in the collection, except those relating to procedure, with which I do not profess to deal. Some of the provisions given are of small importance in themselves, but they serve to illustrate points or rules stated in other portions of the book. The exuberance of the subject itself, and a solicitude to Insert every thing which could be deemed useful, have swell ed the notes greatly beyond what was originally expect ed and intended; and yet the learned reader will per ceive that they might have been made still more exten sive; that much has been emitted by design, and much, no doubt, through inadvertence. All the American works of celebrity and merit have been carefully con sulted, and though some others, of a contrary descrip tion, have been entirely neglected, yet it may not be improper to apologize for a number of references to loose and obscure reporters. A few additional English authorities have been collected, and in two or three in stances it has been attempted to Supply, however imper fectly, some omissions of the author - omissions arising not from ignorance or carelessness, but from his desire to compress the work and it is uht unlikely that, upon careful examination, what might at first sight have ap peared an emission, would be found to be no other than a necessary deduction from some principle which had been before fully stated. The editor submits his la bours, such as they are, to the candour of the profes sion, and if they should be thought undeserving of ap probation, he has at least this consolation, that they can not detract from the merit of the original work.
