Depuis longtemps, le viol est considéré en France comme un crime. Le viol conjugal faisait exception. Le mari avait le droit d'avoir des rapports sexuels avec sa femme, y compris contre la volonté de cette dernière et par la force. Depuis la loi du 4 avril 2006, le code pénal reconnaît le viol entre conjoints comme un viol aggravé. Pourtant, les victimes portent rarement plainte et lorsqu'elles le font, les affaires sont souvent jugées, non pas en cour d'assises comme tous les crimes, mais au tribunal correctionnel. Le viol conjugal est occulté par son invisibilité, lorsqu'il a lieu entre les murs d'un domicile commun. Comme les autres violences sexuelles, il laisse peu de traces visibles : ni bleu, ni plaie. Le viol conjugal, crime du quotidien, est à l'opposé du fait divers. Peu propice aux raccourcis accrocheurs, le sujet est éclairé par les contributions d'un collectif multidisciplinaire associant médecins, psychologues, sociologues et juristes. Ce livre montre l'urgence d'un infléchissement des pratiques judiciaires.

On devine clairement les voix des femmes twas dans ce rapport, qui plaident pour des changements et la reconnaissance de leurs droits – en tant qu’autochtones et en tant que femmes. Malgré la discrimination et la pauvreté qui sont leur lot quotidien, elles sont pleines d’énergie, d’idées et de courage, ce que ce rapport suffit à démontrer. La question foncière est aujourd’hui de premier ordre pour les femmes comme pour les communautés twas. Les Twas étaient traditionnellement dépendants des forêts et des territoires sur lesquelles ils vivaient. Or aujourd’hui, la plupart des Twas sont sans terre. Leur culture et leur existence même sont en danger. Qui plus est, les changements profonds qui affectent aujourd’hui leurs sociétés sont en train de remettre en question le statut traditionnel d’égalité entre hommes et femmes. Ce rapport présente les politiques gouvernementales et les instruments juridiques internationaux relatifs aux droits humains que les Twas et les organisations qui les soutiennent pourraient utiliser au Burundi, en Ouganda, en République démocratique du Congo et au Rwanda. En guise de conclusion, le rapport offre des recommandations aux gouvernements de ces Etats et aux organisations de développement.

This volume draws together examples from throughout the Francophone world, including countries such as Algeria, Morocco, Lebanon, Rwanda, Cameroon, Congo, Côte d’Ivoire, Haiti, New Caledonia, Quebec and France, and across genres such as autobiography, poetry, theater, film, fiction and visual art to provide a cohesive analysis of the representation of trauma. In addition to the survivors’ expression of trauma, the witnesses and receivers are also taken into account. By gathering studies that explore diverse bodily and psychological traumas through tropes such as repetition, silence and working-through, it tackles ethical responsibility and interrogates how expressive forms evoke a terrible reality through the use of imagination. The aim of this volume is not to question if suffering is representable, but rather to examine to what extent art surpasses its own limitations and goes straight to its essence. Although the risks of money laundering and terrorist financing do not appear to be particularly significant in Rwanda, further action should be taken to bolster the legal framework, improve its implementation, strengthen overall supervision of reporting entities within the financial sector, and mitigate the potential domestic and cross-border risks.
