Le sursis à exécution représente une procedure juridictionnelle destineé à s'opposer aux mefaits du temps. Pourtant, coexistent en fait de nombreuses formes de sursis a exécution. Les rapports entretenus par la procédure d'urgence avec le recours principal demeurent toutefois équivoques. L'autonomie des sursis à l'encontre de la procédure principale fait l'objet de la première partie de l'étude. La seconde partie s'intéresse, quant à elle, à la subsidiarité de la procédure d'urgence. En tout état de cause, les sursis à exécution, garantie essentielle des droits de la défense, devront connaître certains aménagements afin d'offrir une protection efficace aux administrés.

Le caractère inégalitaire du processus normatif se retrouve au plan contentieux, du fait du principe de l'effet non suspensif des recours juridictionnels. Le juge administratif possède la faculté de censurer les normes irrégulières et ce pouvoir s'étend jusqu'à la suspension provisoire de leurs effets. Par le prononce du sursis à exécution, le juge rétablit l'égalité des prétentions des justiciables. Il se donne dans le même temps les moyens d'intervenir efficacement sur le litige au fond, dans un contexte marqué par une durée excessive de l'instance. Le sursis remplit donc une fonction pratiquement essentielle. Supprimant les inconvénients de l'effet non suspensif des recours, il en renforce la légitimité. La technique contentieuse ne peut donc être présentée comme organisée au profit de la puissance publique. Il appartient au juge de concilier à titre provisoire, dans le cadre d'une procédure d'urgence, les impératifs de l'action administrative et du contrôle juridictionnel. La protection du justiciable est ainsi complète et efficace. Cette présentation classique suppose toutefois que cette procédure soit effectivement utilisée au profit des justiciables. A défaut, il ne s'agit que d'une garantie formelle à vocation instrumentale. Pour cela, la neutralité de la procédure et celle du juge, dans la mesure où il est maitre de son action, sont nécessaires. Or, il apparait que ces impératifs ne sont guère respectés. On peut en tirer deux séries d'enseignements. Les premiers sont relatifs à la pertinence de la présentation classique du système français de soumission de l'administration au droit. Les seconds tiennent à l'attitude du juge administratif, dont l'œuvre de conciliation prend ici l'aspect d'une protection des prérogatives de la puissance publique, par limitation de ses pouvoirs de contrôle.
