Ce ne sont pas tant les différentes dispositions du statut qui focalisent les discussions que son existence. L'actuel débat n'est que le reflet d'interrogations récurrentes sur la pertinence d'un statut général. Il existe une rhétorique consistant à attaquer le " statut " des fonctionnaires. Elle est illustrée par le dessin de René Le Honzec figurant en couverture de cet ouvrage. Mais au-delà du discours, qui relève du réquisitoire, il est nécessaire de s'interroger sur la raison d'être du " statut ". Quelle est la signification de l'idée de " statut général de la fonction publique " ? Quels étaient les objectifs poursuivis par ses concepteurs ? Retirer le bénéfice du statut soulève de nombreuses questions sur la situation des agents, notamment territoriaux. Le statut établit des valeurs et des principes mais pose également des droits et des obligations (récemment renforcés). Peut-on remettre en cause le statut sans fragiliser la situation des agents et les missions de service public qu'ils assument ? L'on peut également se demander pourquoi l'idée de statut est contestée pour les fonctionnaires alors qu'elle reste attractive pour d'autres catégories d'agents ou d'élus. Les textes et la jurisprudence ont ainsi doté les contractuels d'une forme de statut. De même, un statut de l'élu est une revendication permanente. L'adoption d'un statut les concernant semble une nécessité alors que le statut des fonctionnaires est remis en cause... Il existe des raisons à la contestation du statut général de la fonction publique. Sa remise en cause peut s'expliquer par l'attrait de modèles concurrents (modèles étrangers de fonction publique et droit commun du travail). Elle est également justifiée par des éléments du statut qui cristallisent la contestation : le principe du concours, le système de la carrière, la généralité du statut, les effectifs et le coût qu'elle induit, etc. La légitimité et l'objet de ces critiques méritent d'être discutés pour mesurer la pertinence du statut et engager une réflexion rationnelle sur l'avenir de la fonction publique.

La personne morale apparaît comme le terme réunificateur de tout système representative. Dans l'ordre international, ce processus est perturbé par la présence, dans les organs intergouvernementaux, de représentants d'Etat qui sont autant d'organes des Etats membres, présence prolongée par le consentement aux actes adoptés en leur sein. Quel en est donc le sujet d'imputation : l'organisation ou ses membres ? Une théorie de l'acte doit être développée au coeur de la théorie de l'organe pour démontrer que l'organisation internationale est la personnification juridique d'une collectivité d'Etats dotée d'un système représentatif, et n'est que cela. La qualité de partie à un traité constitutif et de membre d'une organisation internationale ne prive l'Etat d'aucun des attributs de la souveraineté dans l'ordre international. Au contraire, la faculté d'investir un sujet de droit de compétences nouvelles est précisément un attribut de la souveraineté : l'organisation est tout entière une création des Etats membres. Leur souveraineté n'inhibe pas le processus de personnification de l'organisation qui, en retour, ne la confisque pas : la souveraineté et la relativité des rapports juridiques demeurent les principes régulateurs de l'ordre international.
