Le projet de loi de réforme (sauvegarde des entreprises) du 12/05/2004 ne devrait pas, en revanche, contribuer à une évolution semblable de la matière.

Book excerpt: Les objectifs de la loi du 25 janvier 1985 étaient particulièrement ambitieux, il s'agissait de faire prévaloir l'intérêt économique et la notion d'intérêt de l'entreprise. Ce dispositif a tenté d'établir sinon une synthèse, du moins une recherche de cohérence entre le droit du travail et le droit commercial. Ainsi, deux droits qui pour beaucoup ont vocation à s'opposer vont, dans le cadre des procédures collectives, s'interpénétrer. Cette interpénétration a pour effet de rendre le régime du sort des contrats de travail dans les entreprises en difficulté partiellement dérogatoire au régime de droit commun. Aujourd'hui, après quinze années d'application de la loi de 1985, la sanction judiciaire des règles applicables en ce domaine reste encore pour partie à définir. Cette obscurité réside dans la pluralité de juridictions compétentes : d'une part le tribunal de commerce et d'autre part le conseil des prud'hommes. Cette dispersion du contentieux provoque un enchevêtrement de compétences matérielles. Si le rôle du conseil des prud'hommes se clarifie et si la jurisprudence récente permet de vérifier que le droit du travail n'a pas toujours vocation à s'effacer devant la spécificité du droit des procédures collectives, il n'en reste pas moins que sur certains points, la jurisprudence de la Cour de cassation devrait être modifiée, tant dans un souci de cohérence entre le droit du travail et le droit des procédures collectives que dans un souci de clarté juridique.

Book excerpt: Annoncée de longue date, la réforme (ou plutôt le " toilettage ") du 10 juin 1994 tente de renouveler un droit des procédures collectives incapable d'apporter des réponses satisfaisantes aux problèmes que pose la " faillite ". Si officiellement les objectifs initiaux de la loi de 1985 sont maintenus, dans les faits leur dynamique a été entièrement bouleversée. L'examen de la poursuite de l'activité contractuelle, moment crucial de la procédure sauf prononcé d'emblée de la liquidation judiciaire, démontre le paradoxe de la réforme. Non seulement celle-ci menace la poursuite d'activité, mais encore elle remet en cause le caractère collectif de la procédure en autorisant les initiatives individuelles de certains créanciers. En revanche la loi de 1994 confirme les effets radicaux produits par la " faillite " sur le droit des obligations. Le contrat, véritable bien, devient un instrument économique et s'émancipe de l'emprise de ceux qui lui ont donné naissance, induisant en cela une véritable recomposition de la théorie des contrats. Par-delà le traitement des difficultés des entreprises, la loi de 1994 pose également un réel problème de " légistique ". En effet, cette réforme parcellaire et partisane n'est que partiellement cohérente, tant avec les dispositions de la loi de 1985, qu'avec d'autres textes ayant vocation à s'appliquer dans le cadre des " faillites ". La loi nouvelle exprime les aléas d'un processus d'élaboration législatif en grande difficulté.

The outcome is a collective agreement that defines terms of employment - typically wages, working hours and in-work benefits. The agreement affords labour protection: minimum wages, regular earnings; limits on working hours and predictable work schedules; safe working environments; parental leave and sick leave; and a fair share in the benefits of increased productivity. The International Labour Organization (ILO) Collective Agreements Recommendation 1951 (No. 91) considers, where appropriate and having regard to national practice, that measures should be taken to extend the application of all or some provisions of a collective agreement to all employers and workers included wthin the domain of the agreement. The extension of a collective agreement generalises the terms and conditions of employment, agreed between organised firms and workers, represented through their association(s) and union(s), to the non-organised firms within a sector, occupation or territory. The collection of chapters in this volume are about the extension of collective agreements as an act of public policy.

Book excerpt: World Development Report 1994 examines the link between infrastructure and development and explores ways in which developing countries can improve both the provision and the quality of infrastructure services. In recent decades, developing countries have made substantial investments in infrastructure, achieving dramatic gains for households and producers by expanding their access to services such as safe water, sanitation, electric power, telecommunications, and transport. Even more infrastructure investment and expansion are needed in order to extend the reach of services - especially to people living in rural areas and to the poor. But as this report shows, the quantity of investment cannot be the exclusive focus of policy. Improving the quality of infrastructure service also is vital. Both quantity and quality improvements are essential to modernize and diversify production, help countries compete internationally, and accommodate rapid urbanization. The report identifies the basic cause of poor past performance as inadequate institutional incentives for improving the provision of infrastructure. To promote more efficient and responsive service delivery, incentives need to be changed through commercial management, competition, and user involvement. Several trends are helping to improve the performance of infrastructure. First, innovation in technology and in the regulatory management of markets makes more diversity possible in the supply of services. Second, an evaluation of the role of government is leading to a shift from direct government provision of services to increasing private sector provision and recent experience in many countries with public-private partnerships is highlighting new ways to increase efficiency and expand services. Third, increased concern about social and environmental sustainability has heightened public interest in infrastructure design and performance.

More precisely, which conditions and arrangements facilitate and hinders social innovation? We explore these questions using different types of data and methods, and studying different contexts. In particular, we focus on innovations that aim at solving problems of the young unemployed, single parents and migrants. This analysis is based on original research carried out in the period 2010-2013 in the framework of a European project with a specific empirical research strategy.
