Pourtant, loin de ce principe communément accepté, les relations entre secteur public et droit de la concurrence apparaissent conflictuelles. Les autorités de concurrence ont réagi à ce "déni de justice" en développant une approche de détachabilité permettant d'isoler l'activité économique de l'acte administratif marqué par l'exercice de ces prérogatives, accroissant ainsi leur champ de compétence. En retour, les juridictions administratives ont réagi en consacrant la pleine applicabilité des dispositions de concurrence à l'ensemble des actes administratifs (Partie 1). L'étude de l'application du droit de la concurrence au secteur public révèle une adaptation de ce droit aux spécificités du secteur public, révélant de nouveaux instruments juridiques. Ainsi, la libéralisation des monopoles d'Etat exige le recours à plusieurs dispositions, dont l'article 86 (ex-article 90) UE. La libéralisation suscite une réaction de diversification des anciens monopoles qui développent des activités entrant directement en concurrence avec les opérateurs traditionnels. Les moyens du contrôle de droit public et de droit de la concurrence ne suffisent pas à encadrer ces activités. Il faut donc recourir à la mise en place de nouveaux instruments juridiques inspirés du droit communautaire (séparations juridique, matérielle et comptable). La portée ultime de ces deux formes d'ouverture à la concurrence des anciens monopoles d'Etat est de remettre en cause le financement du service public. L'exemption communautaire de service public peut permettre le financement de certaines obligations de service public, mais l'interprétation actuelle des critères de l'article 86.2 (ex-article 90.2) UE limite sa mise en oeuvre aux aspects quantitatifs de ces obligations (Partie 2) .
