Une rupture est identifiée avec la conception parlementaire de la démocratie, car le législateur devient limité par des règles et des principes de rang supérieur, dont la violation est sanctionnée par un juge. Il convient de soumettre à un examen critique la conséquence qu'en tire la doctrine, c'est-à-dire la perte de compétences du Parlement dans la protection des droits. D'une part, le Parlement dispose d'une compétence de concrétisation des droits fondamentaux grâce à sa fonction législative. Cette compétence est protégée par les Constitutions allemande et française, et n'est pas remise en cause par l'entrée en vigueur du Human Rights Act 1998 au Royaume-Uni. D'autre part, le Parlement joue un rôle dans la sanction des atteintes aux droits fondamentaux. La fonction de contrôle lui permet d'étendre sa compétence d'information, mais aussi le champ de la responsabilité du gouvernement, au respect des droits fondamentaux. Elle lui offre également des voies de recours devant le juge constitutionnel à l'encontre de la loi votée. La fonction de représentation, quant à elle, crée un lien direct entre le Parlement et les victimes des violations de leurs droits, en lui donnant une compétence dans la résolution extrajudiciaire des litiges. Book excerpt: Politics in eighteenth-century France was dominated by the relationship between the crown and the magistrates of the Parlement of Paris. The Parlement provided a traditional check upon the King's authority, but after 1750 it entered a period of prolonged confrontation with the government of Louis XV. The religious, financial and administrative policies of the monarchy were subject to sustained opposition, and the magistrates employed arguments which challenged the foundations of royal authority. This struggle was brought to an abrupt conclusion in 1771, when Chancellor de Maupeou implemented a royal revolution, breaking the power of the Parlement. In order to explain why the crown and the Parlement drifted into conflict, this study re-examines the conduct of government under Louis XV, the role of the magistrates, and the structure of judicial politics in eighteenth-century France.

He examines how French writers and scholars reshaped the myths, symbols, and memories of pre-modern communities. Engaging with the myth of 'our ancestors the Gauls' and its ideological triumph over the competing myth of 'our ancestors the Franks', this study explores the ways in which the struggle developed, and the values that the two discourses enshrined, the collective actors they portrayed, and the memories they evoked. D'Auria draws attention to the continuity between ethnic discourses and national narratives and to the competition between various groups in their claims to represent the nation and to define their past as the 'true' history of France.
