Tra le principali problematiche si menzionano: — la consegna ritardata o parziale dei lavori; — il risarcimento dei danni per sospensione illegittima e tardiva ripresa dei lavori; — il riconoscimento di compensi per sorpresa geologica o per maggiori oneri esecutivi; — il concordamento di nuovi prezzi; — le contestazioni in merito alla contabilità dei lavori; — le proroghe e le penali; — l’andamento anomalo dei lavori; — lo scioglimento del contratto; — le risultanze del collaudo tecnico-amministrativo o del certificato di regolare esecuzione. Un’innovazione importante per la trattazione non contenziosa delle riserve in corso d’opera è data dalla procedura di accordo bonario e dalla transazione. Ai fini della loro ammissibilità occorre, però, tenere presente che le riserve concernenti l’esecuzione e la registrazione dei lavori sono atti a forma vincolata quanto a tempo e modalità di formulazione come stabilito nel capitolato speciale d’appalto. La finalità delle riserve è anche quella di fornire alla stazione appaltante uno strumento di controllo continuo della spesa stanziata.

In The Fascist Effect, Reto Hofmann uncovers the ideological links that tied Japan to Italy, drawing on extensive materials from Japanese and Italian archives to shed light on the formation of fascist history and practice in Japan and beyond. Moving between personal experiences, diplomatic and cultural relations, and geopolitical considerations, Hofmann shows that interwar Japan found in fascism a resource to develop a new order at a time of capitalist crisis. Japanese thinkers and politicians debated fascism as part of a wider effort to overcome a range of modern woes, including class conflict and moral degeneration, through measures that fostered national cohesion and social order. Hofmann demonstrates that fascism in Japan was neither a European import nor a domestic product; it was, rather, the result of a complex process of global transmission and reformulation. By focusing on how interwar Japanese understood fascism, Hofmann recuperates a historical debate that has been largely disregarded by historians, even though its extent reveals that fascism occupied a central position in the politics of interwar Japan. Far from being a vague term, as postwar historiography has so often claimed, for Japanese of all backgrounds who came of age from the 1920s to the 1940s, fascism conjured up a set of concrete associations, including nationalism, leadership, economics, and a drive toward empire and a new world order.

Book excerpt: Since the Cold War ended, China has become a global symbol of disregard for human rights, while the United States has positioned itself as the world’s chief exporter of the rule of law. How did lawlessness become an axiom about Chineseness rather than a fact needing to be verified empirically, and how did the United States assume the mantle of law’s universal appeal? In a series of wide-ranging inquiries, Teemu Ruskola investigates the history of “legal Orientalism”: a set of globally circulating narratives about what law is and who has it. For example, why is China said not to have a history of corporate law, as a way of explaining its “failure” to develop capitalism on its own? Ruskola shows how a European tradition of philosophical prejudices about Chinese law developed into a distinctively American ideology of empire, influential to this day. The first Sino-U.S. treaty in 1844 authorized the extraterritorial application of American law in a putatively lawless China. A kind of legal imperialism, this practice long predated U.S. territorial colonialism after the Spanish-American War in 1898, and found its fullest expression in an American district court’s jurisdiction over the “District of China.” With urgent contemporary implications, legal Orientalism lives on in the enduring damage wrought on the U.S. Constitution by late nineteenth-century anti-Chinese immigration laws, and in the self-Orientalizing reforms of Chinese law today. In the global politics of trade and human rights, legal Orientalism continues to shape modern subjectivities, institutions, and geopolitics in powerful and unacknowledged ways.
