Book excerpt: Lorsqu'il y a un dommage matériel et une assurance qui garantit ce dommage, on se trouve alors devant une situation complexe où se mêlent soudain les lois de la responsabilité et celles de l'assurance. En effet, selon les règles de la première, le responsable doit réparer le préjudice qu'il a causé alors que selon les règles de la seconde, l'assureur doit garantir le dommage subi par la victime, laquelle, cependant, ne doit s’enrichir du fait du contrat d’assurance soumis au principe indemnitaire, et elle ne doit pas d’avantage s’enrichir par le jeu de la responsabilité civile. Or, s’il pouvait cumuler la garantie de l’assureur et la réparation de l’auteur du dommage, la victime du préjudice recevrait deux indemnisations. Pour éviter cet enrichissement prohibé par le principe indemnitaire, une seule solution s'impose : celle qui consiste à donner à l'assureur des dommages -après qu'il aura indemnisé la victime- la possibilité de former un recours contre le responsable du sinistre. Ainsi, conformément à l'usage qui permet à un assureur ayant indemnisé une victime de bénéficier d'une action subrogatoire, l'assureur pourra-t-il utiliser les droits de la personne à laquelle il aura versé l'indemnité d'assurance pour demander des dommages et intérêts au responsable du sinistre. De cette manière, la victime ne recevra qu'une seule indemnisation tandis que le responsable s'acquittera comme il se doit de sa dette. Situation des plus équitables. Cette recherche est consacrée à l'étude de ces recours subrogatoires, à leur évolution ainsi qu'aux conditions de leur mise en oeuvre dans les législations française et jordanienne.

Book excerpt: This volume discusses the emergence and role of the art salon in the Arab region in the nineteenth and twentieth centuries, focusing on Algeria, Tunisia, Egypt, Lebanon and Iraq. Institutional forms of exhibiting and teaching art emerged in the Middle East and North Africa in late colonial and early post-colonial contexts. The book examines how the salon had an impact on the formation of taste and on debates on art, and discusses the transfers and cultural interactions between the Middle East, North Africa and Europe. Following the institutional model of the Paris salons, art salons emerged in Algiers, Tunis and Cairo starting in the late 1880s. In Beirut, the salon tradition reached its peak only after independence in the mid-twentieth century. Baghdad never had a formal salon, but alternative spaces and exhibition formats developed in Iraq from the late 1940s onwards. As in Paris, the salons in the region often defined the criteria of artistic production and public taste. The impact of the salon also lay in its ability to convey particular values, attitudes and aspirations. At the same time, the values and attitudes promoted by the salon as well as the salon itself were often subject to debate, which led to the creation of counter-salons or alternative exhibition practices. The art salon helps us to understand changes in the art systems of these countries, including the development of art schools, exhibition spaces and artist societies, and gives insight into the power dynamics at play. It also highlights networks and circulations between the Arab region and Europe.

MALEBRANCHE'S THEORY OF BEING His fIrst work, The Search After Truth, appeared from 1674-76, some fourteen to sixteen years after his dramatic encounter with Descartes' work; to this day it is the only work unfailingly associated with his name, though it was the first of nine studies and several volumes of responses in which he went on to explore and develop his thought. Malebranche criticizes the prevailing theories of sense perception, imagination, memory and cognition, and fIrst proposes his own theory of how we acquire and evaluate ideas - from mathematical to physical, and moral to self-reflective. Underlying this theory is his rejection of Scholastic Aristotelian metaphysics, in which particular beings are said to have powers or forms that act on our minds to inform us. Malebranche - here in company with other critics . of that metaphysics from Montaigne to Bacon and Hobbes - argues that the prevailing view of beings endowed with powers by which they act unilaterally, as "causes" in the full sense of that word, makes no sense and cannot be confirmed by experience. For Malebranche, on the other hand, power can be predicated univocally only of God. Created beings have only that limited power given by God under the conditions of creation.

Creative solutions are needed to address the impact of high government wages and employment on competitiveness. Industrial policy could help overcome the incentives that encourage companies to focus on the nontradable sector, but should be handled carefully, keeping lessons from other countries’ experiences in mind. Export orientation and competition are crucial mechanisms to ensure discipline. Strengthening human capital to raise productivity and provide workers with the skills needed in the private sector will be essential to success.
