Book excerpt: La loi du 4 mai 2004, relative à la formation professionnelle et au dialogue social, avait profondément remanié le système français de formation en faisant notamment émerger le concept de formation tout au long de la vie, reprenant ainsi l'essentiel du contenu négocié par les partenaires sociaux dans le cadre de l'Accord national interprofessionnel qu'ils avaient conclu le 5 décembre 2003. La nouvelle loi du 24 novembre 2009, relative à l'orientation et à la formation professionnelle tout au long de la vie, s'appuie également très largement sur le contenu du dialogue social issu, cette fois, des dispositions de l'Accord national interprofessionnel du 7 janvier 2009. Même si la loi de 2009 n'est pas aussi novatrice que celle de 2004, elle n'en constitue pas moins une loi très importante en faisant émerger cette fois les concepts de professionnalisation et de sécurisation des parcours professionnels. Cette loi ambitionne de clarifier le système de formation en simplifiant et en rendant plus opérationnels certains dispositifs (DIF, CIF, etc.). Par ailleurs, cette loi affiche également la volonté des Pouvoirs publics d'améliorer la transparence d'un marché (réforme des OPCA et du contrôle de l'activité des organismes de formation, etc.) dont l'opacité est souvent dénoncée. En " cernant " le nouveau cadre juridique de la formation professionnelle continue, l'ouvrage présente de manière approfondie le rôle des différents acteurs (tant externes qu'internes à l'entreprise) ainsi que les différents dispositifs de formation, tels que désormais accessibles, depuis la réforme, aux entreprises et à leurs salariés.
