Elle s’intéresse à la généralisation du contrôle a posteriori par le Règlement général sur la protection des donnés, avec transformation des autorités de protection des données personnelles en autorité de contrôle a posteriori. Ce changement externe et visible correspond à une transformation profonde de la nature du droit de la protection des données personnelles, tel qu’il est mis en place comme droit positif européen par le Règlement. En Europe, le Règlement général sur la protection des données marque une nette volonté d’encourager l’action civile, à titre individuel ou collectif, a ! n de responsabiliser les responsables du traitement et les sous-traitants, de sanctionner les comportements fautifs ou négligents et de garantir la réparation des dommages subis par les personnes concernées, en cas de violation des dispositions du Règlement. La présente étude reprend le débat sur la protection des données dans le contexte technologique de l’ère digitale pour évaluer l’impact du Règlement général sur la protection des données en Europe et en Suisse.

Ces technologies sont une source d'innovation pour notre système de santé que ce soit de manière économique ou médicale. Cependant, il existe des risques en termes de droits et des libertés des personnes qui peuvent entrainer une défiance vis-à-vis du numérique. C'est dans ce contexte que le règlement européen de la protection des données de sante a été publié. On se pose alors la question quel est son impact sur les recherches impliquant la personne humaine qui sont déjà très encadrées par la règlementation avec notamment les bonnes pratiques cliniques, la loi informatique et libertés. Nous verrons ainsi l'impact sur les méthodologies de référence CNIL. Le Règlement Général sur la Protection des Données vient renforcer les droits et les libertés des personnes concernées par le traitement de leurs données à caractère personnel. Si la responsabilisation des acteurs, le principe de transparence sont renforcés, la grande nouveauté est l'analyse d'impact relative à la protection des données. Cette analyse sera expliquée et illustrée par un exemple.

Book excerpt: The 2018 FAO-OIE-WHO (Tripartite) zoonoses guide, “Taking A Multisectoral, One Health Approach: A Tripartite Guide to Addressing Zoonotic Diseases in Countries” (2018 TZG) is being jointly developed to provide member countries with practical guidance on OH approaches to build national mechanisms for multisectoral coordination, communication, and collaboration to address zoonotic disease threats at the animal-human-environment interface. The 2018 TZG updates and expands on the guidance in the one previous jointly-developed, zoonoses-specific guidance document: the 2008 Tripartite “Zoonotic Diseases: A Guide to Establishing Collaboration between Animal and Human Health Sectors at the Country Level”, developed in WHO South-East Asia Region and Western Pacific Region. The 2018 TZG supports building by countries of the resilience and capacity to address emerging and endemic zoonotic diseases such as avian influenza, rabies, Ebola, and Rift Valley fever, as well as food-borne diseases and antimicrobial resistance, and to minimize their impacts on health, livelihoods, and economies. It additionally supports country efforts to implement WHO International Health Regulations (2005) and OIE international standards, to address gaps identified through external and internal health system evaluations, and to achieve targets of the Sustainable Development Goals. The 2018 TZG provides relevant country ministries and agencies with lessons learned and good practices identified from country-level experiences in taking OH approaches for preparedness, prevention, detection and response to zoonotic disease threats, and provides guidance on multisectoral communication, coordination, and collaboration. It informs on regional and country-level OH activities and relevant unisectoral and multisectoral tools available for countries to use.
